108. Elisha Uzzell

One source gives another Elisha who married Lydia May and one says thisone,
there are too many Elisha's. It is possible the parents he is with arenot his, but believe it to be correct. His daughters are listed in thedivision of Matthew Uzzell estate about 1878, because their father isalready dead. M.W. McQuin (McQueen) and Lydia Benson, and Mary Ann Uzzell.

Elisha is listed in the 1840 census of Texas as owning 354 acres on whichhe has completed the patent and 12 slaves.

He is listed on the 1850 Montgomery Co. TX. Census line 19/19
either 41 or 47 years old farmer RE value $2500. with Lydia age 35,Major M age 15, Matila age 12; Mary Ann age 10; Louisa age 8; Lydia age2.

Our G-Grandfather Elisha Uzzell born about 1803-4 married first to Chellywho died in March of 1833 leaving 3 little girls who soon died and a babyboy Major William, so very soon Elisha posted a marriage bond in the sumof $200. and in Sept. 1833 he and Lydia May, daughter of William May andMatilda Whatley were married in Marengo Co., AL. by a JP. The courthousewas closed for repairs so in November when the repairs were finished theyobtained a license, which was duly posted.

Elisha and Lydia and family immigrated to Texas in 1839 and establishedtheir plantation at Dacus Prairie, in Montgomery Co., TX. He prosperedand purchased more land and the family stepped " high, wide andhandsome". The children attended boarding school in Galveston and the1860 census list the names of 16 slaves. As each child married he or shewas given land for a farm and home.

Lydia May Uzzell was a very useful woman, she had studied medicine andattended both white and Negro sick people.

But then Reconstruction came and the trouble began. One of the ex-slavesdemanded his 40 acres and a mule promised by the carpetbag government anda big fight came on. Major May Uzzell (Elisha's son) killed the Negro andfled down into Mexico.

In the meantime the white men had been put in jail, however as they werereleased, the Uzzell family and some of their neighbors and some loyalex-slaves started for Mexico, went down to Tuxpan, a well fortified townin the state of Vera Cruz to join Major May Uzzell. They turned west andElisha planned to establish a plantation in the foothills of the SierraMadre Mountains. However Elisha died in 1868 and is buried there in thevillage of Pasreal, Mexico.

As soon as Texas was re-admitted to the United States, they all startedhome for Texas. For some reason the Uzzells stopped near old Ft. Parkerin Limestone County and Lydia May Uzzell died October 1880 and she andsome of the other Uzzells are buried in Ft. Parker Cemetery.


233. Major May Uzzell

An opinion was delivered in the Supreme Court of Texas on 28 February1882 in
the case of T.W. Smith v. Aurena Uzzell. [56 Tex. 315; 1882 Tex. LEXIS34]
A later case on the same issue and with the same parties, but taking into
account new evidence on both sides, was argued in T.W. Smith v. Ansona J.
Uzzell et al. (sic). [61 Tex. 220; 1884 Tex. LEXIS 78] The cases treatthe
question of homestead abandonment.

Here is the data of genealogical interest from the first case:

"This suit was brought by the widow and children of M. M. Uzzell,deceased,
to recover a tract of land, basing their right so to do upon the claimthat
the property was the homestead of M. M. Uzzell and his family and hadnever
been abandoned.

"The property was purchased by M. M. Uzzell in the year 1865, and in the
succeeding year he married and settled upon the land and there liveduntil
early in the year 1868, at which time he removed to Tuspan, in therepublic
of Mexico, after having sold all of his personal property except such ashe
carried with him to Mexico.

"...a judgment [was] rendered against M. M. Uzzell in February, 1871,with
regular chain of title thereunder.

..........

"The record shows that when he left Texas and removed to Mexico, hedeclared
his intention not to return, expressing dissatisfaction with thisgovernment,
and persuading others to accompany him, and proposing to purchase a homein
Mexico for a friend where orange groves were to be found.....

"It does not clearly appear when M. M. Uzzell returned to Texas, but thenext
that was seen of him in Texas by any witness who testified in the causewas
in the year 1873, at which time he was in Montgomery county, that,however,
not then being his residence.

"It does not appear that M. M. Uzzell ever returned to the land in
controversy or attempted to use the same as a homestead after his returnfrom
Mexico; but it does appear that although he lived until the 9th day of
October, 1878, after his return from Mexico, he continued to live in the
counties of Navarro and Limestone. The record is silent as to whether he
ever acquired a homestead in either of those counties or not. Upon his
return from Mexico he stated that he bought land while there.

..........

"...on the 4th day of January, 1872, he conveyed the land in controversyto
Lydia Uzzell, he not being joined by his wife in such conveyance. This
conveyance was made after the date of the sheriff's deed...."

Well, that pretty well tells the tale. We are talking here about MajorMay
Uzzell, grandson of Major Uzzell (1777-1844) and son of Elisha Uzzell
(1796-1866). Elisha was married to Lydia May, and they had a daughterLydia
who would have been a sister to Major May Uzzell. "Tuspan" is clearlyTuxpan
Valley, Mexico, which lies at the Gulf of Mexico between Veracruz and
Tampico. There are other Mexican place names of Tuxpan, but not whereyou
would find orange groves, I don't believe. "Ansona" is, I feel, amisprint
of Aurena, and I think she was the second wife -- certainly the surviving
one!

Finally, the second case makes reference to another such homestead
abandonment case that was considered by the Texas Supreme Ct. at its Feb.
1882 term. It is at 56 Tex. 319 (as opposed to 56 Tex. 315) and concerns
another family. It occurs to me that I now need to go find that physical
volume and see just how many families were suing for their land. We know
from the account given that Major May Uzzell didn't go off on his own,but
had one or more friends or associates with him. If nothing else, the
surname(s) in question needs to be researched on genforum, rootsweb and
elsewhere to see if there's any mention of those families going toMexico.
Maybe they have some pieces of the puzzle that didn't get passed down inthe
Uzzell lines.

I give and devise to my sons Lafayette, Aldon and James Smith the sum ofone dollar each. I give and devise to my son John Smith the sum of onehundred dollars, enough of said sum to be applied in
payment of a note he holds against me for about eighty dollars.

I give and bequeath all of my household and kitchen furniture to mydaughters Tirzah, Charlottie, Zilphia Kornegay, Dora, Cora, Ora and myson Thomas Smith all to have an equal share.

Each to have enough in value to equal that I have already given Zilpha,which consist of one feather bed, four quilts, one counterpane, onesheet, one set of pillows and cases, one bolster and case, one
bedstead and one trunk.

I give and bequeath the residue of my property of every kind anddescription also the interest I may have in my father John M. Uzzell'sestate or elsewhere to my daughter Tirzah, Charlottie, Zilpha Kornegay,Dora, Cora, Ora and my son Thomas Smith. To be equally divided amongthemselves as they may choose and direct.

I hear by appoint and request that Tirzah Smith act as my Executor tothis my last will and testament, hear by revoking and declaring all otherpaper writings purporting to be a will made by me at any time,

Tirzah Uzzell and Shade I. Wooten were appointed Administrators of ThomasEstate and Tizrah was guardian of the minor children until her death whenO.K. Uzzell applied. In 1875 the value given for Thomas Uzzell's estatewas $12,500.00.
S.I. Wooten resigned as Administrator 9 July 1891 and Atlas T. wasappointed 11 July 1891 and final settlement was made soon after.

Division of Estate was received 27 March 1891, recorded on 29 March 1891in Liber 66 #40 page 427.

W.T. Yelverton was the Probate Judge in almost every document filed.

Tirzah Uzzell guardian to heirs of Thomas Uzzell audited and filed April18 1878. On April 10 1878 it is noted that Mary Ann has married and herhusband William Woodard, Jr. signs with her for her part.

On the guardianship report for John Randolph, and Major W. cash is paidMrs. Wooten for board and Kinsey for tuition.

Audited report of O.K. Uzzell as guardian of Fanny R. 13 Feb. 1879,another of same dated 1 Feb. 1881, giving that on Oct. 20, 1880 herestate was charged with telegraph fee of $2.63 and preparing grave andyard $2.00.

Final Account for Fannie R. Uzzell recorded July 1, 1885 balance on finalaccount of $361.77 with each sibling receiving $36.17 7/10 dated April 9,1885.

It was ruled that widow was to receive her 1/3 dower and jury of 5persons to set apart. This suit ends 3 Jan. 1876.

On report dated 25 January 1884 Winnie is noted with husband JamesWarters, and Mary Ann is noted as Mary Ann Woodard wife of WilliamWoodard, Jr.

They make a petition to sell land on 10 February 1884 in Hope Township ofWayne Co., NC.
All heirs with guardian O. K. for K. S. and R. L. partition of lands thatbelonged to Fannie R. who has died, 275 acres. Each is entitled to have1/10 except R. L. who is entitled to 1/10 as heir and who also representsand takes interest of Thomas W., another brother of said Deceased.

#1 to Wright S. Uzzell bounded as follows, begin at a stake in theRockford Road and runs SW to a ditch bridge, then up the ditch NW then NEthen E, then SW to the beginning containing 148 acres more or less valuedat $2826.25

#2 & #3 O.K. and A.T. Uzzell, beginning at a dogwood at R.L. Wooten'scorner and s to a sweet gum on bank of Neuse River and down the river toa stake B. Rouse corner(Now Gardners) then NW to a stake, corner of anacre sold to said Rouse then NE to a stake at said corner, NW to stake inRockford Road then NE to a sweet gum and NW, then SW to the beginningcontaining in both lots 303 acres valued at $5757.00

Uzzell beginning at the mouth of ditch on Bear Creek andParks corner and down the run of creek W. to a stake and SW to a pine onthe mill side Se to a stake at the crook of the road and SW on thePocosin road and along road to Henry Parks, deceased, corner then NE tothe beginning, 275 acres $3300.

#8 R. L. Uzzell, beginning at a stake corner of #7 and down run of creekto mouth of small ditch then SW to a stake on the hill SE to the road anddown road to a dogwood on Pocosin Road and up road to Lot 7 then withline to beginning, 275 acres valued at $4625.

Tirzah Smith

Tirzah Uzzell sued all the children saying Thomas died July 1875 and shewas entitled to 1/3 his property as a reasonable dower. Five personsappointed as jurors to allot and set apart her 1/3 dower 19 Nov. 1875.


282. Wright Smith Uzzell

W.S. Uzzell, et. al applied to court 10 Feb. 1884 to sell the land inLenoir Co., NC. this land is described at being on the Neuse River andadjoining land of William Coker, R.L. Wooten, Josiah Wooten, JerryWarters and _____Jarman containing about 500 acres.


283. Onestus Kilpatrick Uzzell

I just checked the old bible images that I downloaded from the Library ofVA. One of the marriages: "Mary L. Stanton and O.K. Uzzell were marriedMay the 28th A.D. 1884". There was a Charlie Uzzell from Greene Co.living when I was
young, in Greene Co. Or it may have been Wayne. My home was just abouta mile from Ruffin's (or Peacock's) bridge on NC 58. I'm not real clearfrom memory just where the county lines were. ( NC Hwy. 58 runsdiagonally through Greene Co. on to Wilson Co. and Stantonburg. Do notknow where Stanton Cemetery was. RP)
Just for the record. Onestus? No wonder they called him O.K.

This bible belonged to my great grandfather, George W. Stanton,Stantonburg, NC. Since Mary was his daughter, I expect that the marriagetook place in the home, or at least locally. It was probably the firstmarriage for O.K., since she died young. But I don't have any dates forhim. If the marriage occurred in 1884, and she was born in 1864, itundoubtedly was her first and only marriage. I grew up in the samehouse, and the bible was there all that time.
Of course copiers didn't exist at that time, and I never made any handtranscriptions. I later had copier copies from family members, but theyweren't very good. Don't know who submitted them to the Library of VA,but they
rendered a real service. As I said, she was buried in the Stanton familyplot, but no trace of O.K. If he was born in 1849, as your messagestated, he would have been much older than she.

Wayne Co. Heritage states that he was a NC House of Representative memberand County Clerk of Wayne Co.


286. John Randolph Uzzell

Wayne Co. Heritage says he graduated from University of North Carolina in1881, got a law degree in 1882 and practiced in Wilson, NC. (WilsonCounty or town?)


288. Major William Uzzell

Major William Uzzell and Emma Lee Britt Uzzell came to Prairie Co., AR asmall town called Uzzell. Major Williams brother Onestus KilpatrickUzzell ran the post office and a grocery store or trading post.

Major William lived in the small community of Crossroads in Prairie Co.


289. Kirby Smith Uzzell

Wayne Co. Heritage says he received his BS degree from UNC in June 1886.


290. Robert Lee Uzzell

O.K. Uzzell guardian of R.L. paid him $335.12 on 26 Dec. 1879 and signedby T.W. Uzzell.

Wayne Co. Heritage says he graduated UNC in class of 1886.


116. Lucretia Uzzell

I would like any information on Lucretia Uzzell Edwards(b.ca.1816-d.1897) of Greene County, NC. She is buried on the old Edwardsfarm, Bullhead Township., Apple Tree Rd.. She purchased land from GaryEdmundson in 1851 and from Abraham D. Swinson in 1855, where she is nowburied.
She had three children: Piercy (b. 5-20-1843, d.3-5-1925), Rebecca(b.ca.1845), and William Henry (b. 12-26-47,d. 9-11-1890). I amspecifically looking for her husbands name. He is not listed in the 1850census. I believe that his name may have been William Henry Edwards, Sr.and was called Henry, but I have no proof. 125. James Groves

James Groves was a wagon maker. In 1853 he sold the land left him by hisfather and left TN. He was in St. Genevieve Co., Mo in the 1860 census,in Perry township St. Francois Co., Mo in the 1870 and 1880 census. Hedied in St. Francois Co., Mo. after June 14, 1880.(This from Sallie Moon)
