died 1742. He married MARY Abt. 1698.

This Gershom is not proven to be the father of these children
except for Caleb.
That George made his will in this same area of deed below and
the name Gershom has connected them for me but I know it is not
proof.
Received from the NJ Archives filed there as F2 page 378 and
379 a land deed for Gershom Wiggins (spelled Wiggans throughout)
to Caleb Wiggins, deed made 12th February 1741 and recorded 10
April 1745.
To all Christian people to whom this present writing may come,
I gershom Wiggins of Millstone River in the County of Somerset in
the Province of New Jersey, Yeoman, send greeting. Know ye that I
gershom Wiggins as well for and in consideration of the natural
love and affection which I bear unto my beloved son Caleb Wiggins
as for divers other causes and consideration herewith moving, have
given granted and by these presents do fully, give and confirm for
ever a certain tract of land lying upon the Millstone River in
Somerset County containing 250 acres more or less, beginning at a
small hickory sapling marked on all four sides being Harrison's
corner and from thence NNW along the line of trees of Christopher
Bookmans till it comes to Fox Brook thence running along the said
brook to a large hickory tree upon John Van Dikes line thence
South along Van Dikes line to corner between J. Van Dike and
gershom Wiggins and John Harrison, thence along Harrisons line
being 2-3 Hickory trees, they being marked to the place where we
first begun it.
It being a tract of land which gershom Wiggins bought of John
Harrison, Sr. being bounded on north by gershom Wiggins and now in
possession of Rulef Covonovon west by John Van Dike south by John
Harrison and east by Christopher Bookman.
It goes along for several paragraphs saying that everything on
this property is to be given to Caleb, his heirs and assigns
forever.
In witness whereof I the said gershom Wiggins have hereunto
set my hand and seal this 12th day of Feb. in the fourteenth year
of the reign of our sovereign Lord, George II, King of Great
Britain AD one thousand seven hundred and forty/forty one.

did declare that he was present and saw gershom Wiggins sign and
as his voluntary act deliver the within instrument for the uses
therein.

The will of John Harrison of Perth Amboy, NJ dated February 8
1709/10 mentions 4 daughters, un named and has 500 pounds due from
gershom Wiggins in Somerset County, by bond.(this was an abstract
of Charles Garner file at Rutgers U))
I received a copy of the will and inventory of John Harrison
of Perth Amboy (Middlesex Co.) he had 4 daughters and they were
named: Elizabeth, Sarah, Mary and can't read the other name.
Several sons, some of which were not of age, sons including John,
Edward, Harry? and 1-2 more. Harrison was quite wealthy by what I
can make out of his inventory.
There were some Harrison's in Dobbs Co. NC also.
Buried at Vienna, Independence Township Warren County, on a
stone still standing in a place used as a graveyard appears, G.
Wiggins died 1742
This was Sussex Co. in 1740, there was a Walter Wiggins living
there sometime around this period and had sons/grandsons there
later. Some think this graveyard may be on that property but not
much is known for sure.

file at Rutgers University at New Brunswick, NJ.
The reason for including the will of John Harrison is that
this is a clue to Gershom's wife's maiden name. Gershom and Thomas
Wiggins registered their earmarks (brand) May 10, 1709 in
Piscataway, Middlesex Co. NJ and Edward Harrison also registered
his the same day. The fact that gershom bought the land from
Harrison and Harrison's son lives next to him indicate there may
be some family relationship here. It was said that if a young man
did not have land, that the father of the girl whom he wanted to
marry would loan him money to buy so his daughter would be well
taken care of. This probably happened in the case of Robert S.
Lyon and his father in law, James Lewis. Lewis had it in his will
that he had given them money so what was owed taken out of their
part. And another son in law was mentioned the same way.
Gershom Wiggins is mentioned in the will of John Van Dyke made
12 April 1757 as Van Dyke had purchased 230 acres in Somerset Co.
from Gershom, where Van Dyke's son was already living.
Many of the Quaker men called themselves yeoman, but some
others did also, meaning a simple, honest man. The western part of
NJ was settled by Quakers I am told, and this includes Somerset.
It appears from present map that Princeton is now located in
Mercer County, not Somerset. At least John and some of his
descendants had slaves which is not the mark of a Quaker.
Some Quaker records were researched for Dobbs County, North
Carolina and there was a Quaker Monthly meeting on Falling Creek
by 1758 but their records have been lost. They were active here
only a few years before the Quakers moved over into Wayne County.
There are some records there of Wiggins in 1891.
The Millstone River seems to begin about Piscataway and flows
south and to the east of Princeton and on down to run into
another, larger River.
The above deed was signed by gershom Wiggins with a small g as
I have indicated as did his grandson Gershom in the court
documents in suit over Ellenor and Charlotte selling the land
before they were of age in 1792-1803.

This grant must have either been given to or bought by John
Sr.
Entries and Warrants from Dobbs County, 1741-1757 transcribed
by Wm. L. Murphy of Raleigh, NC. dated 10 June 1746 Gershom
Wiggins 300 acres Craven, on N. Side of Nuse at a place commonly
known by the name Sloop Landing on the upper side of Falling Creek
Begg (Bogg?) at a white Oak and ending at a maple on the upper end
of the Land. (Is this the beginning of the process which the above
completes?)
He is also listed in the Johnston Co. NC Militia as Gersham
Sr. with his nephew, son of John, as Gersham, Jr. in 1755.
He is the Executor of George's estate in NJ. Is he the same
one later listed in Morris Co. NJ in 1776?

A Caleb is listed on the Craven Co. tax list of 1769 and 1779.
He is also listed on muster roll of Capt. Lewis Bryan's Company in
Craven County 25 October 1754.
Craven Co. Deed Book 1 page 527 Caleb bought 320 acres from
Abiah Bangs, widow of Jonathan Bangs in 1750 and in 1780 he sold
80 acres to William Stansell, Book 24, page 283.
22 April 1763, Samuel Branton received a 50 acre grant in
Craven Co. on N. side of Neuse River joining Caleb Wiggins.
Is this the same Caleb whose father Gershom gave him 240 acres
in Somerset County, NJ on Millstone River and 1 side bounded by
Fox Creek? in 1741? and did he have a son John who could be the
witness on deed of John Wiggins to Thomas Wiggins in 1741?
More work needs to be done in Craven to try to locate Caleb
and family. He died too early to be shown on any of the Federal
census. I think all the Wiggins in Craven are accounted for, in
another family so if Caleb left descendants, they are probably in
NJ.

2. GEORGE2 WIGGINS (GERSHAM1) was born Abt. 1705, and
died 1750 in Somerset County, NJ. He married MARGARET.

1702-1750
The land mentioned below was in Craven Co. NC till 1746 when
Johnston Co. was created. It became Dobbs in 1758 until 1791 when
Lenoir was created. County lines changed some in 1804 taking in
some more of Craven Co.
Book 5 Colonial Deeds, Cert...... # 3056 page 272 George
Wiggins is granted 262 acres in Craven County on North side of
Neuse River on Falling Creek. The date on the original grant is
not readable except for the 174_.
27 September 1748, a grant to Richard Byrd for land south of
Falling Creek in Johnston County, NC showed a boundary with George
Wiggins. George's grant was also next to land of Major Croom.
The will of George Wiggins (Wigin/Wigon) of Somerset Co. NJ
was written 31 October 1749 and was proved 8 May 1750 and recorded
in Book E of Wills page 396.
It is written fairly small and lines close together and quite
hard to read. A few words were just "guessed at" after having read
several other wills of about the same time period. And punctuation
and capitalization are about nil in the original document but I am
using them here for clarity.
"In the name of God, Amen, the thirty first of October in the
year of our Lord one thousand seven hundred and forty nine, I
George Wigins late of the Neuse River in Johnston County in the
province of North Carolina but now in the province of New Jersey
and county of Somerset being very sick and weak in body but of
perfect mind and memory thanks be given unto God thanks for
calling unto mind the mortality of my body and knowing that it is
appointed for all men once to dye, do make and ordain this my last
will and testament, that is to say principally and first of all I
give and recommend my Soule unto the hands of God that gave it and
for my body I recommend it to the earth to be buried in a
Christian like and do---T manner at the discretion of my
Executors, nothing doubting but at the general resurrection I
shall ro--th soms? adjoin by the mighty power of God and as
touching such worldly estate whom it hath pleased God to give me
in this life, I give devise and dispose of the land in the
following manner and form: Item: I give and bequeath unto
Margaret, my dearly beloved wife the use of 200 acres of land
lying and being in the County of Johnston and province of North
Carolina lying on each side of Falling Creek for and having use of
so long until my beloved son John Wigins arrives to the age of
twenty one years and no longer, together with all my household
goods and moveables in the said Carolina the bottom? enabling him
to pay my lawful and just debts therein and for the bringing up
and edycating my said son in looming/farming?
Item: I give unto my said son the above mentioned two hundred
acres of land by him fully to be possessed of and enjoyed by him
and his heirs and assigns forever together with the remainder and
remains of my estate in the province of New Jersey.
Item: I give unto Gershom Wigons the son of my brother John
Wigins seventy acres of land adjoining to the lower end of the
above mentioned two hundred acres to be fully possessed and
enjoyed by him his heirs and assigns forever.
Item: I give unto my beloved brother Gershom Wigins the sum of
twenty pounds to be raised and levied out of my estate in the
province of New Jersey whom I likewise construct, make and ordain
my only and sole executor of this my last will and testament
empowering him, my said executor to sell or convey any land or
lands to me belonging in the province of New Jersey or any other
efforts on any that I was empowered to sell or convey on any
account.
Item: I give unto my sister Rachell the sum of forty pounds to
be raised and levied out of my estate to be paid to the legatee at

Somerset County and swore on the holy evangelize to say they were

Falling Creek Craven County, North Carolina on 9 March, 1736.

17 February 1737 Ambrose Ayriss 480 acres in Craven joining
Falling Creek and John Wiggins. Airs and Ayriss is what is mostly
spelled Ayres today.
From the book of NC Grants John Wiggins #3841 page 1, 22
November 1738, 100 acres in Craven Co. on the north side of the
Neuse River.
4 April 1745 John Giles 250 acres in Craven on N. side of
Neuse joining E. side of Stirupp Creek, John Wiggins and Neuse.
This should probably say Gersham Wiggins instead of John as he was
the one who had the land on Stirrup Creek and bordering on John
Gills/Giles, unless John has bought this from Gersham?(his
brother)
It is possible Gersham, John's brother, gave or sold this to
him without making a deed?or it was defaulted to John?
In some other land deeds though, dated March 1787, John lived
N. side of Neuse on Stirrup Creek joining Spencer Caldwell (deed
referenced) Higotty Martin, and Isaac and Richard Crooms.
John also received 566 acres in Craven County on Stoneyton
Creek on 13 June 1738. (Grant Book 97 page 212) Falling Creek is
west and north of Kinston. Stoneyton and Loosing Creek are north
and east of Kinston.
John sold part of this 566 acre tract to William Bond, next to
Tower and Hill. NE boundary was land of MacKilwean. Thomas bought
from William Bond between Nov. 1746 and April 1750 Book 1 page
1.
On 21 October, 1741 John Wiggins, Sr. sold 63 acres to Thomas
Wiggins," beginning where I live" (Craven County Deed Book 1 page
378) The next day John sold 100 acres to Phillip Wothers, Craven
County Deed Book 1 page 375, and another John Wiggins was witness
to both deeds. John was in Deed books until 1759. (This second
John Wiggins may be the son of John Sr. or is a son of Thomas or
Gershom, John Sr.'s brothers.)
1 April 1751 Stephen Blackman receives a 400 acre grant in
Johnston Co. on North side of Neuse River joining RICHARD WIGGINS
and John Blackman lines (Lenoir) this is from Dobbs Grants
1741-1756. WHO IS HE? There are two more entries for him.
23 February 1754 William Bond was granted 100 acres in
Johnston on N. side of Neuse joining James McIIweaney and land
purchased of Thomas Wiggins.
May 23 1757 John Wiggins granted 170 acres in Johnston on N.
side of Neuse and on side of Falling Creek joining a marsh near
Benjamin Herring's line and George Wiggins.
3 March 1759 John Tucker 125 acres in Johnston Co. on N. side
of Neuse and on W. side of Falling Creek joining John
Wiggins.
3 March 1759 Edward Bruce Dobbs 150 acres in Johnston on N.
side of Neuse joining Phillip Woothouse, John Wiggins, William
Bond, John Griffin, Francis Mackiiwean and Governor Dobbs.
In 1740 a jury found him not guilty in case of King (of
England, I assume) vs John Wiggins.
Captain Joseph Bryan's Company of Militia of Craven County on
14 April 1753 shows John, and 2 Edmond's. This implies he was
living on Loosing Creek, as Falling Creek was in Johnston County
at this time.
Secretary of State Wills and Administrations show that
Margaret Wiggins was named Admr. for John Wiggins on 20 January,
1768 in Dobbs County. Margaret is listed on the Dobbs Co. Tax List
in 1769.
Richard Caswell was named with Margaret as Admr. He lived near
Kinston and was a distinguished soldier, public servant and
statesman. He became Chief Executive and was elected 1st Governor
after Declaration of Independence and served 6 one year terms plus
one shorter term.
Margaret Wiggins also witnessed the will of William Herritage,
father in law of Richard Caswell in 1769.
In Book 11 page 441 reconstructed Grantee Index of Dobbs,
shows Margaret Wiggins bought from Thomas Custis in 1779.
The Heritage of Lenoir County list an Elizabeth Wiggins
daughter of John Wiggins who received the 566 acre grant and
married John Turner, Sr. and they had a daughter Ann. The dates do
not match up for this.
All of the records of Dobbs County (Lenoir County) except for
one part of land records, burned in 1880 and all that are left to
help solve this puzzle are ones in Craven and some which were in
State Office's.
There was found in Somerset County New Jersey a will for
George Wiggins made in 1749 recorded in 1750 saying he was
formerly of Johnston County, North Carolina, that he has a brother
Gershom, a brother John with a son Gershom, and a sister Rachel
Wiggins. He mentions his wife Margaret and their son John. This
seems to account for the persons who were early in
Craven/Johnston/Dobbs and Lenoir County. I believe this George and
his siblings parents were the Gersham and Mary listed below.
Although the will of George mentioned above does not mention a
brother Caleb these men's probable father Gersham did have a son
Caleb, born about 1714. He was christened at Grace Church in
Jamaica, NY in 1726 at age 12.
The land records have been reconstructed from grantee index
after fires in Lenoir Co. courthouse. They show:

This is certainly the William who was Wayne or Sampson, not
ours. The Sarah Wiggins above may be of another group

206.325.14 John Wiggins died with a will, widow Margaret (Peggy)
remarried to ____ Nicholson. John and Margaret had Eleanor born 18
Dec. 1757 who married John Jones; Charlotte Wiggins md Gray
Westbrook, and Gersham Wiggins. There is a Sarah listed, not sure
if a child or wife of Gersham??

In this same action there was a deposition of Susanna Croom
(1799) she is 43 years old next Nov., born Nov. 1755, she moved
from Tar River (it goes through Edgecombe and ends in Pamilco
Sound) to Neuse River near John Wiggins. Her daughter Betsy and
Eleanor Wiggins same age.
Also a deposition of Major Croom born Lenoir Co. 29 November
1755. (This is not the same Major Croom as given in early land
deeds, may be son or nephew. Major is his name, not his
title)
These records have been received and are listed under Margaret
and Sarah Herring. There are more records to be searched for which
may clear up some questions and may cause others.
**Note from Carlyle A. Wiggins in Dunbar WV in 1966 says a
Richard Wiggins bought 300 acres in Craven County, NC from Authur
Blackman on 3-19-1743. A daughter of an William Blackman (Nancy)
married Ison Uzzell in Johnston Co. 1790.

A long document found in Box DSCR 206.325.14 at North Carolina
Archives from New Bern (NC) District Superior Court Civil Action
papers, and clears up some questions about this family.
State of North Carolina County of Lenoir: Pleas held before
____Sheffield, Fredrick Jones, Walter Dunn, Benjamin Hartfield,
Esq and others of their brother Justice of Peace at courthouse at
Kinston 1st Monday of January 1802...
Be it remembered 1st Monday January 1799 came Spencer Caldwell
by Robert White his attorney and complained of Thomas Curtis, John
Jones and Ellenor his wife and Gray Westbrook and his wife
Charlotte of a plea of covenant broken to his damage of 500 pounds
and the defendants as said, by their attorney William Blackledge
comes and defends the ----injury and damages and says they are in
nothing guilty and pleads declaration to be filed at next term and
plea to be entered and that they wish a jury to hear this
case.
It has been continued from date to date until January 1802 and
the jury Edward Byrd, Benjamin Griffin, Joel Hines, Aaron
Ratcliff, Ezekiel Haley, John Kouse?, Caleb Hooten, Daniel Powell,
John Diamond, William Tuttle, Joshua Byrd and William Erwin find
for the plaintiff on all pleas except on the plea of infancy of
Mrs. Jones and Mrs. Westbrook who the -----under age at the time
and awards the plaintiff damages of 303 pounds and 15 shilling and
cost therefore it is considered by Justices here that he recover
of the defendants as above with which judgement the plaintiff
being dissatisfied prays an appeal to next Superior Court 15 July
who having entered into bond with Hardy Croom and William Tull his
securities for prosecuting said appeal and the same is according

Attached is a copy of court cost.
John Full deposith saying that Thomas Curtis one of the
plaintiffs spoke to him in effect that Ellenor and Charlotte had
agreed to sell the land and requested him to attend and cry that
for them and Ellenor Wiggins bid it off and after the bid of it
off they all appeared to let Spencer Caldwell have it which after
some time he did agree to take it, taking fifty pounds less than
Ellenor bid it off and that previous to this agreement he heard
Peggy Wiggins (say repeatedly that.. marked out) the mother of
Charlotte now the wife of Gray Westbrook one of the present
plaintiffs repeatedly assert that her daughter Charlotte would be
of age
t6e ensuing summer and that if Caldwell would take the land he
could have bond and surety for her making the title as soon as she
did arrive of age. He believes this was done as afterward he saw a
bond to that effect and that he never heard any dispute about the
age of Eleanor. dated 1 Sept. 1804
The deposition of Major Croom, Esq. on a certain matter of
controversy wherein Robert Caldwell, Administrator to Estate of
Spencer Caldwell deceased. Major Croom duly sworn and says that he
had often heard Margaret Wiggins the mother of Ellenor Wiggins now
the wife of John Jones say that Eleanor was near about his age and
that she had often suckled him when she gave suck to Elleanor and
agreeable to the records of my age was born 29th November 1755.

Benjamin Hartsfield JP
Elizabeth Nicholson makes her deposition and said that after
the death of John Wiggins, father of the defendants Elleanor and
Charlotte, the father of the deponent married Margaret Wiggins,
the mother of said girls, and there was in the possession of
Margaret a Bible, the family Bible of John Wiggins and that in the
Bible was written the ages of the children of Margaret and John
Wiggins and that she remembers it was written that Ellenor Wiggins
was born 18 December 1757 and that the deponent knows and has
always understood that Charlotte is younger than Elleanor. Made at
home of Jesse Cobb,Esq at Kinston 4 October.
Gershom Wiggins deposed that (he lived in the family of James
Nicholson after he married his Mother the widow of John Wiggins,
who is father to deponent.... marked out) and that he has
frequently seen the Bible alluded to by the witness Elizabeth
Nicholson and he swears that the ages of his sisters is written
there in the handwriting of his father, John Wiggins, who is also
father to Elleanor and Charlotte. he knows that his sister
Elleanor is older than Charlotte. Home of Jesse Cobb at Kinston 4
Oct, and he also says his father died 18 Dec 1768.
Sarah Smith says she has heard Mrs. Margaret Nicholson, the
mother of Elleanor Jones say that her daughter completed her 10th
year of age on the day that John Wiggins died. Given at home of
Jesse Cobb, Esq at Kinston 4th day of said month, Sarah Smith her
mark.
Mrs. Elizabeth Cobb says in conversation with Mrs. Margaret
Nicholson the mother , she recommended the old lady to remove from
off the plantation where on she then lived as her situation was
uncomfortable, their children had sold the land. The old lady
replied that she kept the possession/ plantation because after her
death the land would belong to the children for that at the time
Elleanor and Charlotte sold the land to Spencer Caldwell they were
both under age. This declaration as to the infancy of her
daughters at the time of executing said deed she has frequently
heard from Mrs. Nicholson.
Samuel Byrd made deposition on 1st September 1804 says that he
was called on ( by Spencer Caldwell.. marked out) to value a piece
of land with Bryan Whitfield, Sr...... the said Caldwell, Gray
Westbrook and others.... at law about in county of Lenoir and they
adjudged the same to be worth $5.00 an acre and that sometime
before he was called on as surveyor to run out and lay off such a
part of the land of John Wiggins deceased as had been given to
Gershom Wiggins and Sarah Wiggins which he believes in the whole
bears about 110 or 120 acres or there about.
Deposition of Susanna Croom said that 43 years in Nov. next
she moved from Tar River to Neuse River near John Wiggins and that
she has lived in the neighborhood the greater part of the
foregoing time within a mile or two of John Wiggins, father of
Elleanor and Charlotte and she was intimate with them for many
years and she has often heard Elleanor and her mother Peggy say
that she was the same age as her daughter Betsy and Betsy was born
Nov. 1755 and she always understood from Elleanor and her mother
that Ellenor was born in the forepart of the year she thinks was
the case from the size and her looks and appearance.
(She would have moved to Neuse River in 1751)
John Jones and Ellenor probably married by 1779 at least.
There are at least 4 John Jones in Dobbs County in 1790 census. A
John Jones does not show in land records until 1757-58, not
necessarily the same as this one.
Gray Westbrook does not show in deed records through 1798.
Moses Westbrook lives next to Gersham and John in the 1790 census
and shows in the land deed records beginning 1779. A James, John
and William also show 1769-1779.
Thomas Curtis sold land to Margaret about 1779 and is probably
the reason he is listed in this suit with Ellenor and Charlotte
and their husbands.

Pleas held before ______Sheffield, Fredrick Jones, Walter
Dunn, Benjamin Hartsfield, ESQ and others of their brother Justice
of Peace at courthouse in Kinston 1st Monday of January 1802.
Be it remembered 1st Monday of January 1799 came Spencer
Caldwell by Robert White his attorney and complained of Thomas
Curtis, John Jones and Ellenor his wife and Gray Westbrook and
Charlotte his wife, a plea of covenant broken to his damage of 500
pounds, and the aforesaid Thomas Curtis, John Jones and Ellenor
his wife, Gray Westbrook and Charlotte his wife represented by
William Blackledge their attorney comes and defends the forced
injury and damages, saying they are in nothing guilty and pleads
declaration to be filed at next term and plea to be entered as of
this term and Spencer Caldwell did likewise, therefore it is
commanded of J.P. that a jury come before court to be held 1st Mon
in April next, for a trial between said parties.
It has been continued from date to date till Jan. 1802 when
parties represented by their attorneys came before jury of Edward
Byrd, Benjamin Griffin, Joel Hines, Aaron Ratcliff~ Ezekiel Haley,
John Kouse? Caleb Hooten, Daniel Powell, John Diamond, William
Tuttle, Joshua Bryd, and William Ervine find for the plaintiff on
all pleas except on the plea of infancy of Mrs. Jones and Mrs.
Westbrook and awards the plaintiff damages of 303 pounds 15
shilling and that he recover from defendant. Defendant paying
court cost.
The plaintiff being dissatisfied prays an appeal to next
Superior Court 15 July and entered into bond with Hardy Croom and
William Tull, securities.

brother named Gray. It must be the younger Gray who married
Margaret Heidelburg in Greene Co. 1818. .

John is mentioned in his fathers will made 31 Oct 1749 and
recorded May 1750 in Somerset County, NJ. The will doesn't give
age just that his mother is in possession of the 200 acres and
other property till he becomes of age and he may be older than
shown.

An Asheal Wiggins was listed once in the Lenoir Land deeds
1799 when he sold to Hardy Croom.
Assail Wiggins is shown to be on census in Laurens County, SC
in 1800 page 35 00010-20100-00. 1M 26-45; 2F-10 and 1F 16-26.
There are not any Wiggins listed till 1840 Jacob pg 38; 1850
Levi pg. 339 1860 M.J. pg 350; S.J. page 300 and William pg.
347.

John Wiggins, son of George Wiggins and Margaret lived at
Sloop Landing on Neuse River.
John Wiggins md Elizabeth Arrington in SC. They lived in
Laurens Co. SC and had a son Asabel.
John Wiggins served in Revolutionary War and died in
Charleston SC about 1777. From Roster of SC Patriots in American
Revolution by Bobby G. Moss mentions John Wiggins who volunteered
11 August 1775 for Capt. William Mills. This is also listed in SC
History and Genealogy III page 137.( I am not familiar with this
publication but have seen Moss's book.
These papers were found and do support above items except for
the part that Margaret, widow of George married Joseph
Williams.

Notes for GERSHAM WIGGINS:
1738-before 1820
The name Gershom is mentioned in the Bible and is a child of
Moses and Zipporah, meaning" a stranger (or alien) in a strange
land" Exodus 2:21 and 18:2-3.
Since Gersham Sr. and Jr. are both listed in the Johnston
County militia in 1755 and the usual age for being included was
18-45 (changed some from year to year, set by the Colonial
Assembly) this earliest grant evidently applied for by Gersham,
Sr., born about 1710. This one must have died before the 1769 date
listed in N.C. Taxpayers or not be in North Carolina, but all the
county Records, except for Grantee Index, from 1746-1880 were
destroyed in the fires of Lenoir County Courthouse. Gersham, Uncle
of this one, is not listed in the reconstructed grantor index so
any change of ownership would have been to family or he did not
meet the terms of the grant and live there long enough or clear
out woods, etc..
Gersham, son of John, was listed in his Uncle George Wiggins
will in 1749 to receive 70 acres on the lower end of George's
grant and his son John the other 200.
James, John, George and Jesse all buy from James Bell between
1810 and 1814. This is the last time James is mentioned. He
probably sold his land before leaving North Carolina
Gersham and John Jr. are both listed on 1790 Dobbs Co. NC
census on page 136. Gersham shows 3 M over 16, 3 females and 3
slaves. John shows 1 M over 16, 3 M under 16 and 2 females.
1800 Lenoir Co. (same as Dobbs) list Gersham and John (Jr.)
page 26
Gersham shows 1 M over 45, 1 M 26-45 and 1 M 16-26. We know
his son James was born 1773 so he is 27 years old. 1 F over 45, 1
F 26-45 and 1 F 10-16. John has 1 M under 10, 1 M 10-15 and 1 M
26-45,2 F under 10, and 1 F 26-45.
1810 Lenoir Co. census includes two George's, Sarah, and W.
John, page 291; One George listed is 26-45, not married and son of
Gersham? Sarah is the wife of John who previously had been listed
in Craven Co. John died in 1803, leaving a will. The other George
and John are John and Sarah's sons. Gersham and John page 288 and
James page 290. Gersham and wife both over 45 (no others in home)
but 6 slaves. James is the one born 1773. The 1810 census for
Craven County is missing.
In 1804 the county line between Craven and Lenoir is moved
causing some Wiggins previously in Craven to now be listed in
Lenoir.
1820 Lenior County list George, James, Jr. and Jesse page 7;
Aaron, James Sr. and Thomas page 8; Caleb and Robert page 11.
Caleb is son of John and Sarah (John died 1803 and Sarah on 1810
census) and the George, Robert and Aaron are his sons. In a
community in that time, Sr. and Jr did not mean father and son,
only that two of same name resided, and Sr. noted the older one.
Jesse has not been proved in the family yet. It seems as close as
all these appear to live to each other, there is some
kinship?
Entries of Claims for Land in Dobbs 1778-1790 by Wm L. Murphy
Book 1 (242)247 January 31 1778 Gershom Wiggins 270 acres Dobbs on
both sides Falling Creek, Joining Wm Barwicks, Wm. Aylors (or
Alyn)(or shown as Ayers) and Major Crooms line. This was surveyed
or finalized 10 November 1784, Book 1
Major Crooms got a 400 acre grant same year and mentions he is
joining John Wiggins, Gershom Wiggins and James Parker.
22 March 1787 Spencer Caldwell granted 80 acres in Dobbs N.
side of Neuse River on Stirrup Creek joining John Wiggins.
Gersham also was granted 72 acres in Lenoir county 25 March
1793 Book 78 page 427.
Tax Records for NC show a Mick Wiggins and Thomas Wiggins in
Dobbs County in 1779. Who are they?
THE PATRIOTS AT MOORES CREEK BRIDGE by B.G. Moss, says this
battle was a deciding factor at the beginning of the Revolutionary
War. This took place 27 February 1776. The British planned to use
the Carolina Loyalist to overthrow the rebellious government but
this did not work. Mr. Moss and other historians have discovered
many things about this battle which was not previously known. He
has tried to establish a list of those participating. He list
"Gorshum Wiggins of Dobbs County, served under Capt. Jesse Cobb
and Col Richard Caswell. These two officers participated in the
battle and Wiggins was possibly in the encounter. Papers, V,
15."
The National Archives has said they have no information on
this man. This spelling or alternate spellings, but it is still
possible he was there, as many papers have been lost.
St. Phillips Parish Records, Barbados, shows that a Gershom
Wiggon, son of George and Christia Wiggon was baptized 20 March
1681. There are other Wiggins listed in these Barbados
records.
On the 1780 Tax List for Dobbs County, NC, Gershom is shown
with value of $1,013 and living in Capt. Henry Taylor District
near La Grange and Institute

(these papers came to me via Agness Gunter from a mention of
them from Roger Krammer to Martha Marble)
Know ye by these presents that we Gershom Wiggins, Moses
Westbrook and James Bright are held and firmly bound to Asahel
Wiggins in sum of 100 pounds to be paid to Asahel Wiggins, his
heirs etc., we bind ourselves this July AD 1799.
A suit was brought by said Asahel Wiggins against Gershom
Wiggins, judgement was against Gershom Wiggins, and being
dissatisfied prayed an appeal to next court and if Gershom will
duly prosecute the said appeal with effect and abide by the
judgement and sentence of said court then the above allegations to
be void and other wise to remain in full force and effect.

This is to certify in Lenoir County Court of Pleas and Quarter
Sessions, among other things is contained as follows, pleas held
before the worshipful Lazarus Pearce, James Bright, Joseph Taylor
Esq. and others of the brethren Justices of the County begin and
held for County of Lenoir at Courthouse in Kinston on 1st Monday
in July year of our Lord 1799.
Be it remembered that on 1st Monday in July 1798 at Kinston
came John Doe by Edward Harris Esq. his attorney and complains of
Richard Roe in custody whereas Asahel Wiggins on 7th March 1798 in
Lenoir County granted and sold to said John Doe a certain tract of
land containing 262 acres in Lenoir lying on the North side of the
Neuse River and on Falling Creek, beginning at a pine thence N.33
degrees W, 240 poles to a pine thence N 57 degrees E, 160 poles to
white oak thence 5 33 degrees E, 300 poles to a hickory to
beginning. To have and hold the said tenement with appurtenances
to said John Doe and his assigns from 1st of March until full term
often years to be completed and was thereof possessed until the
said Richard Roe on 10 March 1798 with force and arms entered and
expelled and removed the said John Doe.
Notice:
To Gershom Wiggins; I am informed that you are in possession
or claim title to the premises mentioned in declaration or to some
part thereof or claim title, I do advise and give notice to appear
on 1st Mon July next court, to cause yourself to be defendant,
otherwise I shall suffer a judgement to be had against me and you
will be turned out of possession.

On that same day 1st Monday July 1798 came William Goodman
Esq. Sheriff and said he did deliver to Gershom Wiggins a copy of
above declaration and Gershom Wiggins came with his attorney
Thomas Badger Esq. and pleaded not guilty whereupon it was ordered
that a jury be summoned, but was continued from court date to
present of July 1799 when parties above and jury consisting of
Elijah Byrd, Joshua Bryd, Leonard Loftin, David George, John
Tuttle, Wondal Davis, Benjamin Coleman, John Partridge, John
Wilson, Elisha Johnson, Willie Garner and John Harrell say the
defendant Gershom Wiggins is guilty and assess six pounds damages
and cost. The defendant dissatisfied with and entered an appeal to
next Superior Court to be held for District of New Bern on 19th
Sept. next, given under my hand and seal 16th Aug. 1799 J. Bright
Copy of court cost and expenses paid for evidence to John Worsham,
Claret Wine, Lemuel Byrd and Sarah Coker.
Laurens County South Carolina
In obedience to an order of Court at Lenoir County in North
Carolina the following deposition was taken:
appeared before me, one of Justices of the County at the house
of Zacheriah Bayly Esq. Elenor Donoho who said she knew George
Wiggins who lived in NC at the place called Sloop Landing on Neuse
River and that she knew John Wiggins to be son of above George
Wiggins and Margaret his wife, and the same John Wiggins came to
this state and she knew him to be the same John Wiggins and he
lived near her in this state and she was with his wife the night
Asahel Wiggins was born and she knows him to be the same Asahel
Wiggins that had lately given Hardy Croom a deed for conveyance of
land and that she believes Asahel was 23 years old last Christmas
to best of her remembrance, 16 Aug. 1798 Elenor Donoho by her mark

Also in Laurens Co. SC same date, place etc comes John Philpot
who says 23 years ago last December he himself was acquainted with
John Wiggins and his wife Elizabeth Wiggins and that the Christmas
Asahel Wiggins was born and he is considered son of John and
Elizabeth Wiggins and he also says he saw Asahel Wiggins deliver
to Hardy Croom an instrument of writing and acknowledged it to be
a deed for a tract of land said Croom had purchased in NC said to
have fallen to Asahel by the death of his father. (in 1777)16 Aug

you to take deposition in the case of Asheal Wiggins vs Gershom
Wiggins from Martha Shockley concerning what she may know about
the controversy, in writing for court on 1st Monday Oct. next.

Edgefield Co. SC deposition taken by John Blocker at my own
house, of Martha Shockley, says she knew George Wiggins who lived
at a place called Sloop Landing on Nuce River and she also knew
John Wiggins was only male heir George Wiggins had and she was
acquainted with him on the Nuce and sometime after John Wiggins
came to this State and was lawfully married to Elizabeth Arrington
by whom he had but one child Ashel Wiggins, and that John enlisted
in the service of US and his wife received a letter about year
1777 that John had died in Charleston while in service. 20 August

Bryan against Daniel Miller, that the title to the land had been

about 1794 he saw Gersham Wiggins and John Pope, who were
securities for Samul Pope, who said they were going to sd. Bryan's
to settle the matter but nothing was done.

also in Box of Misc. Slave papers (a typed transcript is there
plus written copy) also noted as #3794, original mentioned they
were in Box SS314. A deposition and examination of Sarah Wiggins,
wife of Gurshum Wiggins taken at Dobbs County the 12th of April
1772.

That about three years ago Will, a Negro fellow belonging to
her father Benjamin Herring came to her house and asking several
questions about one Gibbs and Curtis and some others, pulled out a
bottle with some Rum in it and ask her to drink of it. She refused
several times but was at last prevailed to drink some and that
after she had drink of it she found herself strangely sick and ask
him what kind of rum it was and he answered it was not for any but
his friends. Sometime after that he came with another bottle and
got her to drink it under the pretence of curing her of what she
drank before and it had an odd taste and she ask him what was in
it and he answered herbs and it had such an effect on her that it
caused her head be as though she was drunk and took away her
senses. He ask whether any person had used her ill and said if
they had he could make them love her better than ever they did.
That he at different times gave her some liquid to drink which
always deprived her of her senses, and by that means had carnal
knowledge of her body. That after he had begot the first child on
her body he threatened that if any person would or did talk about
it he would say or do something that would hurt them and she
understood that he would poison them because he said he had seen
people poison one another and that he could poison others himself
and that she verily believes he knows how to poison anyone and she
was afraid if she disobliged him, he would poison her, that she
thinks Higotty Martin looking so poorly and sickly of late
proceeds from something the said Will had done or gave to him.
That the said Will told her if ever she turned against him he
would do something to her that would kill or otherwise destroy
her---- and that the said Will by behaving in the manner above
mentioned had Carnal Knowledge of her divers times and was the
father of her last child and that he told her he had a good will
to go try Laney Wiggens for he could lye with the best of women if
he tryed them and that they talked of that, that was nothing....
for he could go to her sister Dorcus and serve her as he had this
deponent, that the said Will told her that he had carnal knowledge
of her, afterwards which he denied, and said he would have done it
if she had not desired her not. signed Sarah Wiggins by her
mark.

On the 11th April 1772 Dobbs County, NC Nehemiah Wise for wife
Ann (Dobbs Co), John Hull and Joseph Ratliff of same, personally
appeared before Benjamin Caswell. Nehemiah Wise for his wife in
sum of 500 pounds proclamation money and the sum of 250 pounds
each for Hull and Ratcliff, each to be _____of their goods and
chattels, land and tenement respectively.
To this use of our said Lord and King his heirs and successors
on condition the said Ann Wise shall make her personal appearance
before Chief Justice next Court date 11 May next, then and there
to give evidence in behalf of our said Lord the King against Sarah
Wiggins, wife of Gersham Wiggins on charges of suspicion of having
murdered her own infant child then this recognizance to

This George appears in the census and near to Gershom and
right age to be his son. The census available for him does not

County, North Carolina. He married SARAH Abt. 1775 in Craven or
Dobbs County, North Carolina. She was born 1755, and died Aft.
1810 in Lenoir County, North Carolina.
Notes for JOHN B. WIGGINS:
1750-1803
Tax records list him in 1769 and 1779. No records have been
found to determine that John is the son of John and Margaret but
he is living on the land granted to John in 1738 on Loosing Swamp
and Stoneyton Creek which changed from Craven County to Lenoir in
1804. By this early birth date, where he lived and including the
name of Charlotte (His sister) as his daughters name are the
reasons given, although I know this is not "PROOF". It seems there
is "no such thing" in this county with no records. In the land
dispute in District Civil Action papers and the many depositions
given involving his sisters Charlotte and Ellenor, John has
already died.
Land was granted to John Wiggins December 20, 1791, 150 acres
in Craven County north of Neuse River and on Bear Pocosin joining
Branton and Blackledge. Land Grant Book 79 page 459. This land is
north north east of Kinston, near the land granted 1738 to John,
Sr.
1790 census of Craven County shows Samuel and John, and John
has 1 male over 16 (himself) 3 males under 16 and 4 females.
Craven County census is missing in 1810, but John's widow is in
Lenoir with 5 sons. The county line has changed in 1804. This is
fortunate because Craven's records were not destroyed and his will
is listed. George is the executor of John's will in 1803.
Will of John Wiggins written 16 August 1803 Craven County
mentions wife Sarah, sons Aaron, Caleb, Robert, George, John,
daughters Nancy and Elizabeth. Land was on Wolf Pit Branch and
joined Phillips land. Heirs of Charlotte were mentioned so she is
already dead, It sounds as if George and John are oldest and
already given land. The will was proved in court September 1803.
An inventory list is shown, signed by George in Sept. 1804. Land
mentioned was on Wolf Pit Branch.
In 1746 most of the northern section of Craven became Johnston
county,in 1758 Dobbs was formed from Johnston and in 1791 Dobbs
ceased to exist and Dobbs was split between Greene and Lenoir. The
section on Loosing Swamp and Stoneyton Creek where John had lived
moved into Lenoir County as Craven gave up more land.
John's wife Sarah may be the female over 45 in the household
of Robert Wiggins in 1820 census.

George, the son and executor of his father's will shows in the
1810 and 1820 census and has 1 son born 1800-1810 and 3 daughters
born 1810-1820 but no indication as to their names. (There was
another George in 1810 Lenoir, same age as one mentioned above but
had no family and 2 slaves.)
Robert has on his census in 1820 a woman over 45 living with
him and his wife and young son. Robert and wife both in 26-45 age
bracket. Robert couldn't be any older than 30, probably about 26
or 27. Land records show that Robert bought land from Sarah (his
mother) in 1828 but by the 1830 census she is not shown with her
sons. I have not seen census for Willis Truitt and Nancy.

Her father mentions her heirs in his will of 1803 along with
his other two daughters Nancy and Elizabeth.
She married Willis Truitt 20 Feb. 1800 and died before 11 May
1801 when Willis married her sister Nancy. The word "heirs" was
used, were there twins? Charlotte must have died when child or
twins were born. There wasn't time for more than 1 birth it
seems.

John Wiggins was in the War of 1812 5th Company detached from
Lenoir County.
1810 census records of Lenoir show John had 1M 16-26 and 1 F
10-16.
He married Betsy (Elizabeth ?) Truitt 28 November 1805. If
this census is correct, then Betsy could be less than 16 I rather
doubt this. The census must be incorrect.
John is not listed in the census of Lenoir in 1820 and 1830.
The only Wiggins household having a male this age in the home is
James. But they could be in a Truitt home.
Estate records of Craven show Robert exhibiting inventory for
John Wiggins in December 1835. A short list not giving
relationships.

complainant and the defendant JOHN WIGGINS came into court &
declared that they have made an agreement to the following effect.
It is agreed between JOHN WIGGINS & ELIZABETH his wife that
henceforth they shall separate from bed & board & that
each shall forego & each doth hereby forego & release all
right & claim & interest which either has in the society
of the other. It is agreed also that the said JOHN WIGGINS shall
secure to the said ELIZABETH the sum of - original torn - --- be
approved by the Court of Equity in which in pending the Bill of
the said ELIZABETH against her said husband for alimony.
-ELIZABETH renounces her claim upon the death of said JOHN to any
part of his estate. ---there shall be secured for the separate use
of complainant of the moneys of her husband the sum of $436.09 -
for which sum $269.42 1/3 cents to be paid by CALEB WIGGINS &
$166.66 2/3 cents paid by ROBERT WIGGINS - ordered that the said
CALEB and ROBERT pay this sum within five months - and the said
Clerk shall pay the same to LEVI WHEST who is chosen by
complainant as her Trustee - said Trustee shall pay to ELIZABETH
an annual sum to be worked out - sum of $25 and interest. The said
JOHN WIGGINS to pay court costs.

James.
Elizabeth and Nancy's brother Caleb had a daughter Vicy who
married Jesse Heath, is this the same one mentioned?

Deed index of Craven County shows Robert bought land from
Aaron 1818. Also shows he bought land from John in 1820 and Sarah
in 1828 and from Peter Phillips in 1839.
He is listed in 1820 census of Lenoir with 1 male under 10 1
male and 1 female 26-45 and 1 female over 45 (his mother Louisa?)
1830 shows only male 30-40 and 3 slaves. 1840 shows 1 male 5-10 1
male 40-50 1 female 10-15 1 female 20-30 and 1 female 30-40 and 1
female 40-50 and 1 female 60-70 and 2 slaves, but no further
record is found of him in this area.
He is probably the same as listed on the 1844 Lenoir Co.
Contentney Neck Dist. Tax List with 2 blacks, 202 1/2 acres and
value of $675.00.

This John is merely speculation, but he did live next to
Gershom on the census and John the son of George (Gershom's Uncle)
has already died.
1790 Dobbs County census shows John Wiggins next to Gersham,
and 1M >16; 2M <16 and 2 females.
1800 census shows 1M-10; 1M 10-16; 1M 26-45; 2F -10; 1F
26-45.
1810 census has 1M >45; 2M 16-26; 1F 16-26; 1F 10-15; 1F
>45.
.All four children listed in 1800 are still at home in 1810.
But in 1800 there is 1 son and 1 daughter gone according to 1790
census. They are perhaps in the home of someone else working, or
daughter could be married. These early census do not show
relationships, just who is living there.
James, Thomas and Jesse, sons are listed in the census of 1820
and in the household of James, there is a male his age which could
be the" lost from 1790" brother. John (father) is not listed and
neither is a female who could be John's widow if he had died. So
they both have died or moved out of county?

fire 1878 and again in 1880. A Grantee (buyer) index book was all
that survived. James father sells him 2 plots of land in 1805 Book
23 page 34 and 37 and James buys one plot from James Bell in 1810
Book 24 page 81. This is the last time James is mentioned in the
Index, but this is buyers only.
James signed up for land in Morgan County, Alabama in 1825,
shown in Alabama Land Records, Old Huntsville District.
He is listed in "Old Land Records of Morgan Co., AL" by Cowart
abstracted by Ellouise Wynn.

male under 5, 1 male 5-10, 2 males 10-15, 1 male 15-20, 2 males

Susannah and all the children except for oldest daughter Ann who
had married in N.C. before coming to Alabama and Susannah born in

ALABAMA NEWSPAPERS compiled by Pauline Jones Gandrud, from The
Southern Advocate published at Huntsville 25 July 1840, that he
was one among many who attended a Morgan County Democratic
meeting.
The Post Office Department at Washington, D.C. records show
that James Wiggins was appointed the second Postmaster at Martin's
Store, Morgan County, Alabama on 25 October 1836. Charles Martin
was the first PM and appointed in 1828. James served until 28
January 1839 when Joseph Herring his son in law was appointed. The
name of the Post Office was changed to Cedar Plains, later just
Cedars, and was discontinued in 1904.

Reminiscences of Morgan County No. 12 by A.G. Copeland, Woodlawn,
Alabama.
At an early age, Mr. Wiggins settled in Cedar Plains, where he
amassed fine property, and left an excellent family of sons and
daughters. The oldest fence in the county now stands on his old
farm. It was of red cedar and built eighty years ago, and a sound
structure yet.
Another article said the home James built for his family was
of square hewn, red cedar logs with cracks between logs plastered
inside and out. The two stories contained eight rooms and a large
hall, all with 14 foot ceilings. The kitchen, like the style of
the day was 14 foot square, detached and behind the main
house.
The 1850 mortality schedule of Morgan County, Al. shows that
James died in June 1849 at age 74 born in NC and died of heart
disease.

beginning with page 214 and continuing through page 220.

Note: Jonathan Orr was in Noxubee County, Mississippi at some
time, living there, near his brother? Simon who continued to live
there but Jonathan moved, back to Morgan Co. Al.? From Lucille
Reeves, Editor of Noxubee County Historical Society newsletter. Is
this the same man?
In some research notes on Herring's (James Grandparents) it is
said that they brought the same place names from Bertie County to
Dobbs, and some from back in Isle of Wight Co. VA and do not know
if this is coincidence or what but just east of Hartselle, AL is
Somerville and a Hopewell Cemetery in Morgan County. In Morris Co.
NJ there is a Hopewell Township and in Middlesex County NJ is a
Somerville and on the Millstone River near Princeton (now Mercer
but was Somerset Co.) is a town Kingston, which is the name of the
town in NC. It was originally Kingstown (NC) but after the
Revolution they changed it to Kinston.

Notes for SUSANNA LASSITER:
1785-1861
She came from North Carolina and was not yet born when the
part called Craven County was formed in 1712. Johnston County was
formed in 1746 and covered the area which was to become Dobbs in
1758 and remain so until Lenoir was formed in 1791 and Dobbs was
discontinued. The county lines have probably changed to some
extent since but none so drastically as then.
In 1878 the courthouse in Kinston (Lenoir) was set on fire.
The only records saved were in Register of Deeds Office. In 1880
the building used as temporary courthouse burned and all deed
books burned except the Grantee (Buyer) Index. The Deed Index has
been reconstructed to show land ownership.
Lenoir County Deed Book 22 page 230 shows land bought by Susan
Wiggins from Stephen Lassiter between 1746-1810.
Book 22 was for old Deeds registered under the requirement of
Act of Assembly. This is probably this Susanna and perhaps her
full name is Susan Ann/Anna as this is probably her father. Her
father has the same name at least, but I have not checked enough
records in this area to know if there is more than one. With a
full check of land deeds, this can probably be determined.
I have not seen any other records on Susanna till the death of
her husband, and death of two sons previously and in time she
became Guardian of the minor children, then her own estate
papers.

Book 19 page 31.. This day came John Wiggins son and heir of
Susanna Wiggins, late of said county, deceased and made
application to the court to appoint William D. Harper, the Sheriff
of said court, Ex officio Administrator of the Estate of the said
Susanna Wiggins. It appearing to the satisfaction of the court
that forty days have elapsed since death of Susanna Wiggins.
page 32 William T. Walts, William T. Orr and Willis F. Orr be
appointed appraisers and to report back to the court in sixty
days.
Two more entries on this page report an amount set for slaves
be filed and then the Sheriff files the Appraisers report.
page 33 The Sheriff and said Appraisers/Commissioners have
leave to sell all the personal property, except the slaves, of
Susanna Wiggins Deceased, late of this county. Following this
there are arrangements for what type credit allowed and where and
when notices are to be posted of sale.
page 36 Sheriff makes application to the court to sell Negro
woman Penny belonging to said Susanna. That 2nd Monday in February
be set to hear application and notices be posted.
page 52 The judge being fully satisfied that all requirements
have been made, does grant them leave to sell the Negro woman
Penny at public outcry to highest bidder with notice given on
courthouse door and two other places.
page 55 15 Feb. 1862 Sheriff and appraisers made report on the
sale of personal property (except slave) and report filed.
page 149 17 Feb. 1863 Sowell Jennings Sheriff is hear by
appointed as Ex officio Admr. of Estate of Susanna
page 155 this is again William D. Harper, late Sheriff of
county has filed his vouchers and accounts and ask for final
distribution of estate and ask court to set a date. He filed a
statement under oath of the heirs at law and distributes to said
estate and which it appears that James H. Wiggins, Mary Wiggins,
Matthew Wiggins, Frances Wiggins, Bright Wiggins,(Matthew/marked
out) Walter Wiggins, Josephine Wiggins, James Aycock and Sarah Ann
Aycock are minors under age of twenty one. It is ordered that
Henry M. Mason be appointed to represent the minors in the
settlement and did appear in court and accept appointment.
page 170 The sheriff and commissioners appeared and it was
proved satisfactory to court that notice had been posted for final
settlement. Total of account was $1472.87 cents and entitled to
credits to the amounts of $1192.22 leaving a balance of $282.65 in
the hands of the late sheriff and due the estate.(If I read this
correctly it then says) that the late sheriff Sowell Jennings be
awarded the sum of $282.65 and be discharged.

This is a total owed the estate of Susanna, mostly by her
children and grandchildren $978.70 and due Probate court of Morgan
County, Alabama $282.65.

From the way these notes are put together it seemed they owed
Susanna but in the next series of papers copied it appears that
Susanna owes these notes. More study to be done.
In Book 20 page 463 1863 these heirs are listed James (H),
Mary, Matthew, Mary, Eliza J. married John Brown, Frances, Bright
,Walter, James and Sarah Ann Aycock, James Wiggins, William
Wiggins, Marcella Carter married ___Carter, Mary Ann House, wife
of William B. House, Josephine W. Wiggins, Jesse Wiggins, Anna
Herring, Lucy McDonald, Susan Harris, Harriett Key.
Another page names these as non residents of Alabama: James,
William, Jesse Wiggins, Marcella Carter and Mary Ann House. Also
mentions these minors: Frances, Bright, Walter, James and Sarah A.
Aycock and Josephine W.(Josephine had earlier been in Marshall
County MS but she is not included as a non resident of AL.)
In Feb. 1869 only minors listed are Matthew, Josephine, James
and Sarah Aycock and Jacob L. has died and his Administrator is
mentioned.

George is on the census in Lenoir Co. in 1810 and 1820 and
then is gone.
1810 1M-10; 1M 26-45; 3F -10 and 1F 16-26 and 1 slave. There
is another George but he appears to belong with Gersham's family,
living in that area of Lenoir.
1820 census 1M 10-16;1M 26-45 3 F -10 and 1F 26-44.
The census information is from Agness Wiggins Gunter.
This George appears to be married with 1 son born between
1800-1810, and 3 daughters born between 1810-1820. Apparently
George died and there are numerous records in Pitt Co. about the
children. Samuel Moor Bible seems to fit this family as mentioned
for George Wiggins and Frances.

I have found a lot of records for Thomas M. Wiggins who died
in Pitt Co.,NC 1857-1868, but he didn't seem to
have any children. He was very close to his aunt and uncle,
Samuel and Mary Moore. They left property to him, and they lived
together several years until they died between 1850 and 1857.
Thomas wrote his will 1857 giving
everything to his 3 sisters, Mary E.Murphy, Harriet
Smith,Susan Rice, and their children. There are many estate
papers, because the sisters were arguing over the way Myer Rice
disposed of property. I didn't know who his
parents were, but his mother must be a Moore. The 1820 census
for George Wiggins of Lenoir matches exactly the right ages for
these 3 daughters and one son. I didn't have any records for him
after 1820.

Lenoir County, North Carolina. He married LOUISA TUCKER36 Abt.
1809 in Lenoir County, North Carolina. She was born 1793 in Lenoir
County, North Carolina37, and died 1874 in Lenoir County, North
Carolina.

Lenoir County Heritage mentions that Caleb is son of John B.
and Louisa Tucker and Caleb's daughter Nancy was Fredrick Jones
second wife.
Caleb is listed on census in Lenoir County 1820-1860 but
missing in 1850 but appears in 1860 with Caleb age 70 and Louisa
66 and Lonza McCoy age 4.
Estate Records of Lenoir has a large file with copy of will
giving land to sons Arden and B.F. He loaned property to unnamed
wife until her death, then sold and divided. B.F. Wiggins was
executor. Arden and sisters and nephews sued B.F. The suit lasted
for 12 years. Arden and W.C. died during this time and guardians
too. Lewis Daughtry stated Caleb Wiggins died 11 January 1861.
Nancy Jones, Susan Turnage and Vicey Heath stated they were
daughters of Caleb. Charles, Mary, Mathew, and Judy stated that
they belonged to Caleb (slaves). R.M. Wiggins stated "Grandmother
died 1874." R.M. Wiggins is son of Charles Gersham Wiggins and his
grandmother referred to is Louisa wife of Caleb.

cotton gin.
B.H. LANGSTON " Wyatt Cicero WIGGINS father of ward of
plaintiff and only child. Mother of child died 3-4 years before
Wyatt Cicero WIGGINS. He married my daughter.

1 Dec. 1879 Wyatt Cicero WIGGINS died in Lenoir County leaving
his infant daughter Mary E. W. WIGGINS without guardian and with
considerable estate and property, said daughter only heir. John C.
WIGGINS appointed guardian 27 Dec. 1879.
Arden WIGGINS the intestate defendant and one of the sureties
on said guardian bonds of John C. WIGGINS died in Lenoir 1 March
1885 and defendant F.M. ROUNDTREE was appointed his administrator
on 21 March 1885.
Mary Euginia Winifred WIGGINS and John C. WIGGINS had not
reported estate properly and had held on to it illegally.
This is surely the same Caleb Wiggins who is listed on the
1844 Lenoir Co., Contentney Neck Dist. with 5 blacks, 383 1/2

under age at this time.
1850 census of Craven County NC list him age 50 with William
age 30, John age 24 and James age 18.
The 1840 census of Lenoir Co. shows him with 1 M 10-15; 2 M
15-20; 1 M 20-30, 1 M 40-50, 1 F 40-50 and 8 slaves.
1830 census of Lenoir shows him with 2 M 5-10, 2 M10-15, 1 M
20-30, 1M 30-40, 1 F 10-15, 1 F 15-20 ,1 F 30-40.
1820census of Lenoir shows 1M under 10, 1M 16-26, 3 females
under10, 1 female 26-45. He did have some daughters, their names
are unknown at this time.

He is listed on the 1844 Lenoir Co. (Kinston Dist.) Tax List
with 1 black, 400 acres and value of land $1200. this was viewed
on line from Lenoir web page.

male, all in 26-45 age bracket and 9 slaves.
In 1830 he has 1 M-5; 1 M 5-10; 1 M 20-30; 1 M 40-50; 1 F-5; 1
F 10-15; 1 F 40-50.
In 1840 he has 1M -5; 2M 5-10; 1M 10-15; 1M 40-50;1F 10-15; 1F
30-40 and 1 F 60-70. James lives near Jesse.
The 1850 and 1860 census seems to have names mixed, etc

Is this Sally Wiggins the wife of James? If so wonder why she
does not have children with her?

1850 Richard is listed as Huggins in census but 1880 is listed
as Wiggins
By this time names ages etc given. Richard lives in house 152
and James is in house 150. Elizabeth is listed as a widow and 2
young children on census are probably hers. Holland was listed
with another family in 1870 and had a daughter Mary age 5. In Jan
1882 Lenoir newspaper had "died, Hollan Wiggins pauper"
William H. is listed with the Stevens family in 1850-1860.
Civil War Records show he was born in Lenoir, enlisted age 27,
Aug. 1 1861 and discharged Oct 23 1863 with a disability. 1870
shows him in Kinston township, 1880 in Vance township and 1900 in
the home of his son Bright with his father and mother and brother
Wm. H.

Thomas is listed on the 1820, 1830, 1840 and 1850 census of
Lenoir. His census seems a bit off in 1820, he is 16-26, probably
closer to 26 has 1M 10-16; 2F 16-26 and 1F 25-45. None of these
would seem to be his children, but in 1830 he is listed with 1F
5-10; 1F 10-15 and 2F 30-40 with that his age also. So this looks
like he only has 2 daughters? In 1840 he is 40-50 as is one female
and there is one female in each grouping of 10-15; 15-20; 20-30;
30-40.
So I am not sure about this Thomas being his son?
1850 Thomas is listed as farmer age 51 with Martha age 19,
G.Jones male age 75 and Y. Jones female age 35. Is this his father
in law?
In 1860 Martha lived with the Aldridge family.
1870 Zilpha Wiggins is age 53 on page 214 and Martha age
42.
1880 Martha is 46 and living with Zilpha Jones age 59. Martha
is listed as sister of Zilpha. They lived alone in Kinston.
Thomas (the son) listed on 1850 as laborer wife Polly age 35
Ann age 16, Cullen age 10 Eliza age 5 and Susan 2. In 1860 Thomas
has apparently died and Ann has married a Moore. They are living
in Kinston. All of this family found on the 1870 census is Susan,
Elizer and Mary age 9 months.

He bought land 23 May, 1838 in Lafayette County, Mississippi
and the following is the deed when sold from Book C, page
442-443.
This indenture made this 16th day of April in the year one
thousand eight hundred and forty one between Bright H. Wiggins and
his wife Cnecy? Wiggins of the county and State aforesaid (State
of Alabama, Morgan County, dated 9 Dec.1842) of the one part and
Green L. Hill of the county of Lafayette and the State of
Mississippi of the other part, Witnesseth that for and in
consideration of Eighteen hundred dollars ($1800.00) to the said
Bright H. Wiggins and his wife Enecy Wiggins in hand paid at or
before the unsealing and disclosing of these presents, he the said
Bright H. Wiggins and his wife Enicy Wiggins hath granted,
bargained sold and convey and confirmed and by these presents doth
grant bargain sell and convey and confirm unto the said Green L.
Hill his heirs assigns all that tract or parcel of land lying in
the District of lands sold at Pintoloc, Mississippi described as
follows viz: East half of section 22 Township 8 Range 5 west
containing 320 acres more or less to have and to hold the said
lands and with all the appertuances thereunto belonging to the
only proper use and behoof of him the said Green L. Hill his heirs
and assigns forever, and the said Bright H. Wiggins and his wife
Cresy Wiggins will forever warrant and defend the title of the
same against the claims or claims of themselves their heirs and
assigns and against the claim or claims of all persons whomsoever
claiming under them in witness whereof we have hereunto set our
hands and offer our seals the day and date written above. Signed
and sealed in the presence of Joseph Herring JP
Bright H. Wiggins and Cneoy Wiggins both show to have signed
their name, not just a mark.
I have entered Bright's wife as it looked each time it was
used in the document. It is a puzzle as to what it is.
In the settlement of estate of his father,(beginning 1849) he
is listed as an heir, but is not listed on the 1850 census of
Alabama, and his children are listed as heirs as are the children
of Matthew who defiantly known to have died,
He is shown on the 1840 Lawrence County, Alabama census.
Although ages are in groups, it shows him to be born about 1805,
his wife 1815. There would be a son born about 1830 and 1832,
daughters born about 1833 and 1835 and a boy 1837 and a girl born
1839. I can not find the sons born 1830 and 1832 but the children
found in other family members homes fit the other patterns, then
there is a girl Josephine born about 1841.
One son of Bright, James L. did go to Marshall County Ms. by
1860 and married there that year to Mary E. Boggs. If James
survived the war, he evidently moved somewhere else before 1870 as
he is not listed in Marshall County. Julia, the slave received in
distribution by Josephine, and her 3 children are in Marshall
County, MS in 1870, listed as Wiggins.
Probate Court Book 12 page 282 -285 dated 7 October 1853,
Susannah Wiggins, Joseph Herring and John B. Stuart signed
probably as a guardianship bond. Copy I have is evidently only the
last portion of it. Below there is this Report:
A list of property that has come into my hands as guardian of
MARCELLA, JAMES, MARY ANN AND JOSEPHINE, CHILDREN OF CNICY
WIGGINS, DECEASED.
to wit: Julia age 30, Minty 12, Viney 10, Henry 8, Dolly 6,
Carolina 4 Sally 2. Money and notes: $50. in money 1 note on
Edward Wise for $140.88 1 note on R.B. Nesmith for $16.50, 1 note
on John M. Kent for $25.12 1/2 cents, the last 3 of these due 27
December 1853.
State of Alabama Personally appeared before Mr. A.A. Howlett a
JP in and for county and state aforesaid 18th day October 1853.
Susannah Wiggins made oath that the above list and amounts is
correct as she can make it.

Jesse Wiggins, Guardian of Marcella Wiggins
The following is the proceeding in the Probate Court of
Cherokee County Texas at a special sitting of said court on 21st
day of March AD, 1854
(This petition goes on to say that Marcella is a resident of
Cherokee Co. TX. but still a minor and needs a guardian to manage
her inheritance from her father Bright H. Wiggins from Morgan
County, Alabama. Jesse is stated as a resident of Cherokee County,
Texas also. There is also petition from Marcella saying the same,
her petition signed by William A. Evans and Mary R. Evans, also
noted is that this is only until the 1st day of the next March
term of Probate Court. The bond was given for $1100. even though
the estate was only mentioned to be over $500. signed Jesse
Wiggins
Wood and Wiggins Attorney for petitioner.
The guardianship bond was signed by Jesse Wiggins, William
McKinney and Joseph Turney, recorded 21 March 1854.
Records Book 13 (1853- ) page 135 The State of Alabama, County
of Morgan, Probate Court Special Term April 27, 1854 Comes Jesse
Wiggins Guardian of Marcella Wiggins and applied for an order of
distribution to divide all the personal property belonging to the
estate of Cnicy Wiggins lately deceased of which the said Marcella
is an heir and Legatee. It appearing to the satisfaction of the
court that the said Cnicy Wiggins died leaving the following named
lawful heirs and legatees to wit:
WILLIAM T. WIGGINS, the State of Mississippi, and MARY ANN
WIGGINS, JAMES WIGGINS, JOSEPHINE WIGGINS AND MARCELLA WIGGINS,
all residents of Morgan County Alabama except for Marcella who
resides in Texas. This is ordered (last line on page not
illegible)

and are appointed Commissioners to divide and allot all said
property among the heirs fairly and equally. They are required to
make return of said amount together by Monday 8 May next Special
term of Probate Court to be held for that purpose.
page 139: State of Alabama. Probate court Morgan County May
Term 1854 , Being the 8th of said month. This day came in Joseph
Stroup, Sheriff of said county and return of the report of
commissioners appointed to divided the Negroes belonging to the
estate of Cnicy Wiggins lately deceased. To Wit: the Report of
R.M. Johnson, Jonathon Orr, J.C. Orr and Jonathan Gibson the
commissioners above named who report as follows that they have
divided the property belonging to the Estate of Cnicy Wiggins
among the heirs and legatees of said decedent To Wit: To William
T. Wiggins, Dolly and Carolina valued $775.00; To Marcella
Wiggins, Vina valued at $650. To James Wiggins, Henry valued at
$600 To Josephine Wiggins, Julia and child valued at $800, To Mary
Ann Wiggins, Minta valued at $750 and that William T. Wiggins pay
to Susannah Wiggins guardian the sum of $12.05 and that Josephine
pay to Susannah Wiggins guardian $37.05, that Susannah Wiggins
guardian pay to Marcella Wiggins $12.95 and Susannah pay to Mary
Ann Wiggins $12.95 and to James Wiggins $162.95. which report was
received by the court and same to be entered into record and it is
appearing to the satisfaction of the court that Marcella Wiggins
residing in the State of Texas and that Jesse Wiggins of the State
of Texas is the guardian of the said Marcella and that he has duly
qualified and given bond as such. It is therefore ordered adjudged
and directed by the court that the said Jesse Wiggins guardian of
said Marcella have leave and he is hereby authorized and required
to remove the property above allotted to said Marcella from this
state to the State of Texas and that he take a copy of this order
to the Judge of County Court of Cherokee County in State of Texas
and that the said Jesse A. Wiggins guardian aforesaid pay the
cash/cost in this behalf expended.
The slaves mentioned in earlier document by Susannah as coming
into her care on behalf of children must not be the age they are
given in that paper or the value would not be so high. Sally is
apparently the child of Julia as she is only one not listed by
name. The 1870 census of Marshall County MS. page 449 shows Julia
Wiggins age 50 black born AL. her children are Sarah Wiggins age
18, William Wiggins age 15, Penny and Milley both age 12. These
are the slaves belonging to Josephine, but where is she?

bottom 1/2 of page 256 begins a detailed account of shoes,
bonnets, ribbon and dress material paid to J.W. Falk
1855-1857
and from 1852-1855 tuition paid for both to J.W. and M.J.
Herring and a Dr. bill, apparently for slave of one of the
girls.
page 259 William T. apparently signed receipt at this date of
25 August 1855 to Susannah Wiggins for his share witnessed by
Joseph Herring and John R. Wiggins (his Uncle's by blood and
marriage)
Power of Attorney...State of Mississippi, County of Marshall
15 February 1858 minors over age 14 Mary Ann and Josephine Wiggins
now reside in Marshall County with their brother James, he is
young and not possessed of much experience in management of
estates and feels disinclined to be their guardian.. William M.
Harris, Sr. says they reside with him and he is willing to be the
guardian. His son William, Jr. and another make security
arrangements.
Guardianship is granted to William M. Harris issued 19
February 1858 and in three (3) months he is to present to the
court an inventory of property.
In this last few pages of documents, it is mentioned Marcella
is to receive slave Henry and money. In the original papers she
was to receive Vina and James was to receive Henry, evidently a
change of plans???
In a recent discovery, found that William M. Harris, Sr. is
the father of Albert (AB) Harris who married Susan Wiggins,
Bright's sister. And Albert and Susan's son James S. came to
Marshall Co. and married, their first child being born in Marshall
Co. before they returned to Morgan Co. Al.

George Wiggins was mentioned in his father's estate settlement
and the family Bible, Morgan County, Alabama marriage records for
his first marriage.
In the book "Old Land Records of Morgan Co. , AL" by Cowart
with the abstract sent me by Ellouise Wynn. (I am not sure what
the numbers 174, 175 are unless it is the page listed in book)
George is shown to have received 79.93 acres on 7 June 1856
warrant # 27460 in Township 7 south, Range 4 west, section 28 and
S1/2 of SE 1/4 and also same date and same warrant, 80 acres in
Township 7 south, Range 4 west, section 34, W 1/2 of NW 1/4 for a
total of 159.93 acres.
The Final Record of his Estate Settlement is in Book 16 page
254, with Joseph G. Brown the Administrator dated 23 December
1857. (He died in 1856)

Recorded 20 May, 1858
In 1845, George was sent a letter to Waverly, Lowndes County,
Mississippi. The family has this letter. He was in Ms. in 1843
when his first wife died 1843, but it is not known if he was in
Waverly at that time. By March 1839, Waverly was named. The
settlement was known for it's wealth and refinement. The principal
attractions are it's beautiful women. The men, however, are said
to be powerfully homely. Waverly continued to ship cotton till the
1880's. Today all that remains of the town is the magnificent
mansion of George H. Young, one of the early and influential
residents. It is now in Clay County, MS.

Alabama. There are more young men listed in this household than
can be found later, by census and the listing of heirs in Morgan
County. Perhaps some of his mother's nephews, etc. was living
there also?
William has not been found on the 1850 census. His brother and
4 sisters were living at that census with their Grandmother and 2
uncles in Morgan County, Alabama.
A W..T. Wiggins was listed as being on the Guardianship Bond
with Minerva Mizzle in Noxubee County, Mississippi in 1855.
A William T. Wiggins, of the State of Mississippi, is listed
as an heir of Bright H. and Cincy Wiggins in Morgan County,
Alabama in Book 13 page 135 Morgan County, Alabama April, 1854.
Previously listed as an heir of James Wiggins, who died 1849 and
also as an heir of James wife, Susanna when she died in 1861.
James and Susanna Wiggins were his grandparents.
W.T Wiggins is listed on the Crittenden County, Arkansas 1860
census with his family listing his age as 29, born in Alabama,
occupation: overseer, taken 26-27 day of June in Lucas Township,
Edmondson post office, page 806. His youngest son James Steele
Wiggins born in February 1860 is listed as "Babe" 4/12 months,
male, born Arkansas.
In April 1862 the Conscription Act was passed calling men
18-35. William would be 32 in this year and had wife and 2
children and engaged in agriculture, but he probably heard this
was to be passed and decided to enlist earlier. It was much better
to enlist than be conscripted.
W.T. Wiggins enlisted as a Private in Company A, 19th Regiment
Mississippi Volunteers and appears in the Company Muster Rolls
beginning March 1862.
He enlisted February 28, 1862 at Macon, Mississippi by J.M.
Macon for the period of the war. This Company was originally
mustered in at Macon 25 April 1861 and Capt. was J.M. Macon. It
was also called President Davis Guards. Capt. Macon was mortally
wounded on 5 May 1862, when William T. was wounded at
Williamsburg, Virginia.
Before William joined this Unit, in June 1861 the Regiment was
ordered to Virginia. There it joined the Army of the Shenandoah.
In the winter of 1861-1862 the Regiment joined the Department of
Northern Virginia. This command was subsequently absorbed by the
Army of Northern Virginia. The 19th Mississippi Infantry
participated in a number of various engagements during it's career
but our William T. did not .
Probably from end of Feb. to April they were on the march and
learning to drill, take orders etc. This Regiment participated in
the Siege of Yorktown Virginia from 5 April till May 4, 1862, when
they evacuated and on May 5 the battle in Williamsburg. When the
end of the war came only 5 Corporals and 15 privates of Company A
surrendered. This Regiment lost 15 killed and 85 wounded of the
501 men engaged at Williamsburg.
May/June roll he was noted absent, wounded and on July/August
Roll absent, wounded at Williamsburg May 5 1862. (notation same on
September/October Roll). On November/December he is noted absent,
furloughed. There is one card showing Report of Casualties of the
19th Miss. Vol. at Williamsburg, Virginia May 5 1862 report dated
near Long Bridge May 13, 1862, wounded. Last card in
January/February 1863 shows he died in Mississippi 28 January
1863.

There was a motion for appointment of guardian ad litum (By
court) for these minors, no indication action was taken and no
guardianship mentioned in summons.
Mrs. M.R. Locke (Martha R. Lyon Locke) paid $30.00 burial
expenses, confederate money, 1864.

The final account of the administrator, dated July, 1871,
showed a balance of $312.75 to be divided equally between the two

city of Memphis, Tennessee, you and each of you are cited to
appear before Chancery Court of said county at next term thereof
to be begun and held in and for the county at the courthouse
thereof in the town of Macon in said county, on 2nd Monday in
January AD 1871 to show cause why final account of Charles T.
Thomas, administrator de bonis non of the estate of Mary C.
Wiggins deceased should not be allowed and said administrator

limited term, as sheriff herein appointed)
It is tradition that Wiggins died in the Civil War. He would
have had to die before 1864 or the estate of Mary would not be in
any question. It would have just passed to him. So we can assume
he died before summer of 1864.
A copy of these documents,the newspaper clipping an attached
sworn statement and the other various bits of info were sent to me
by the Editor/President of Noxubee Co. Historical Society. There
were by no means a full record,just bits and pieces in various old
records she searched.
A search of the Memphis (Shelby Co.) Tennessee census was made
and no W.B. and J.S. Wiggins were found. (1870) The Shelby County,
Tn. County Clerk has no records a guardianship was transferred
there in these names.
In November,1993 Pres. Noxubee Hist. Soc. sent me copies of 3
other documents..as follows:
Estate Of M.C. Wiggins.....to R.S. Locke (?) 1864 To Lott(?)
paid in Confederate money, amount being two hundred and sixty five
dollars for which thirty dollars is claimed or allowed for burial
expenses.

The undersigned Administrator(de bonis non) of the estate of
Mary C. Wiggins, deceased, late of said county and state,
respectfully reports by virtue of the order of this court made at
the last of October term 1865 thereof directing and authorizing
him to sell the personal estate of his intestate described in his
application in this behalf after motion made and duly given
according to the state and direction of this court in his behalf
he did on the 31st day of October AD 1865 at the late residence of
the said decedent in this county between the _____ _______ by law
proceed to sell the personal estate to the highest bidder for cash
and did then and there so expose for sale at public outcry the
said personal estate in lots and force to suit purchaser until the
same was fully concluded for a full account of which said sale
with the name of purchaser and the highest amount bid for several
articles your said Administrator begs leave to refer to your honor
to the account of sale herewith filed and marked Exhibit A and
pray to be made a part of this report said account of sale
amounting in this aggregate to the sum of $645.00
This Administrator having now fully reported his procedure in
this behalf prays that the said sale may be approved and confirmed

He is listed on Sunflower County MS Census for 1880. He is 28
and wife Sallie is 22 page 16, house and dwelling # 167.
They are later found in 1900 in Harris County, Texas and death
records of Texas (index) shows them to have died in Bexar County,
Texas. One son stayed in Houston but another moved to San Antonio
and they must have moved with them.

S. Hitchcock is listed just below Martha R. Locke (J.S.'s
aunt) on his brothers census, in 1880 Tate Co., MS list John
Hitchcock age 42. Seaburn is 46. There is a Willie age 10 and
Benny age 2 who are shown to be nephew's to head of house, so are
probably Seburn's. Hitchcock was the security on James S. marriage
bond in 1881 in Tate Co. He later married Martha Ellen's older
sister Mary E. in 1886.
Except for documents in his Mother's Estate and his marriage,
this land deed is the only other document I have found relating to
James Steel.

presents, that I Charles Dillingham receiver of properties of the
Houston and Texas Central Railway appointed by order of the United
States Circuit Court for the Fifth Circuit and Eastern District of
Texas made and entered on the seventh of December 1888 in
Consolidated Suit No. 198 in equity entitled Nelson S. Easton and
James Rentoul trustees and the Farmers Loan and Trust Company
trustee complainant vs the Houston and Texas Central Railway Co.
and Benjamin A. Shepard defendant acting by the authority of the
said order in said suit for and in consideration of three hundred
dollars paid and the sums to be paid as hereinafter stated by
James S. Wiggins of Comanche Co., state aforesaid have granted
sold and conveyed and by these presents do grant sell and convey
to the said James S. Wiggins all that certain land and premises
originally granted to Houston and Texas Central Railway Company by
the State of Texas situated in the County of Comanche in the State
of Texas on the waters of Sabanna Creek about 12 miles N 6 degrees
north from town of Comanche being the south 1/2 of the NE 1/4 of
section #27 in Block 2 by virtue of land script #26/1415 more
particularly described as follows. Beginning at a point on west
line of survey #17 for NE corner of this survey bears N 475 varas
and from which stake a post oak 15 inches in diameter marked HC
bear N 52 degrees E 13 varas a post oak 12 inches in diameter
marked RR bears N 10 varas, thence west 950 varas to the center of
the survey. Thence east 950 varas to the SE corner of this tract,
thence N 475 varas to the place of beginning, containing 80
acres.
Together with all and singular the rights, members,
hereditaments and appurtenances to the same belonging or
appertaining of the consideration mentioned herein the sum of
sixty dollars has been paid in cash, the remainder evidenced by
four obligations of the said James S. Wiggins of even date
herewith for the sum of sixty dollars, each drawn to the order of
Charles Dillingham receiver. Said obligations are due respectfully
one, two, three and four years from date and bear interest payable
annually at the rate of six per centum per annum from date which
said obligation assumed by a deed of trust upon the lands hereby
conveyed of even date herewith executed by the said James S.
Wiggins to James A. Baker, Jr. as trustee for the use benefit of
the legal holder of the obligations. Given under my hand this
third day of November 1890, Charles Dillingham receiver.
On page 435 following above are 3 sworn statements by
authorities selling. On page 436 is another document from Charles
Dillingham to James S. Wiggins giving same land description etc.
and mentions land previously described in Volume C pages 609-612
of Deed Records of Trustees and whereas all the notes described
above have been paid and discharged. This document signed on 27th
day of October AD 1894 and continues with more sworn statements by
various officials.
Also on page 435 filed for record November 30th 1894 at 2
o'clock P.M. and duly recorded the same day N.E. Palmer clerk by
Ovg Delaw deputy.
This is listed in Comanche Co. Deed Records as J. W. Wiggins
but document itself itself says plainly James S. Wiggins.
On Comanche Co. Tax Records 1892 Abstract 465 Houston and
Texas Central Railway, M.E. Wiggins heirs. 80 acres $300.00
value.
Another listing in Tax Records as Abstract 108, 160 acres but
this is apparently a mistake as it is listed elsewhere as
belonging to Levi Fine.
In Comanche Co. Cemetery Book a listing was found for James S.
Wiggins at Sand Hill Cemetery. The survey there was made in 1976
but in 1990 the stone was not found. It was described as a
homemade sandstone with name carved out. "Many of these were found
at this cemetery but many had fallen over with writing to the
ground and were very heavy and could not be moved without
shovel/pry bar etc. of which we had none." by authors of the
Cemetery Book.

Notes for MARTHA ELLEN COOPER:
1860-1941
I have a biased view I suppose of Martha Ellen, as it came
from my mother only with her interpret ion of her parents views,
but here goes...
She seemed to be a strict, very serious, sharp tongued person.
Not a loving Grandma like their other one. Mamo, Rutha Mae did not
like her and only called her Mrs. Guthrie and didn't like her
husband at all.
Charlie didn't have much affection for his mother either, I'm
told, what it was all about, I don't know.
She must have made crops and finished paying for the farm and
her and A.B. Guthrie evidently lived there until he died and then
she moved to Mitchell County, Texas. (This may not be true as
Charlie, James Harlie and Bonnie were listed on Brown county Texas
census in 1900)
The deed says notes were paid in full in November 1894.
Mother seemed to have the idea that Martha Ellen looked down
on the Wiggins part of the family, but she married one, didn't
she? Maybe it was the Robertson's she looked down on, but
apparently she and Bonnie got on fine and she married a
Robertson.
In my Mother's handwriting, found in 1997, source not known at
present,
Martha Ellen Cooper was born in Alabama, May 25, 1860. She was
married to James S. Wiggins in 1881. To this union was born five
children, Charles Luther, J. Harlie, and Bonnie Mae. These 3
survive her, the other two dying in infancy.
J.S. Wiggins died 24 January 1892.
She married A.B. Guthrie in 1895. He died 9 Oct.1937. One
child was born to this union, Pinkney W.
She came to Texas in 1880 to De Leon, Comanche Co. Texas.
She came to Mitchell County in 1937 to make her home with her
children.
her parents were Henry W.L.S. Cooper born 12 January died
Sept. 5, 1900.
Dolly M. Culbertson born 6 Dec. 1842 died 12 Sept, 1883 and
married 27 Feb. 1842.
*There are several discrepancies in above information from
what I had previously from the Bible Record of Dolly Martha or
Martha Ellen (sent to me by Evelyn Wiggins Brown) and the
tombstone of Henry Cooper and the 1900 census showing Henry H.
Cooper. She also did not come to Texas in 1880 as she was married
in Jan. 1881 in Tate Co. Mississippi. Her older sister did not
marry until in fall of 1886. I wonder if Ellen and James came to
Texas before her parents did? If they didn't, then Charlie was
probably born in Tate Co. Ms.
