1. BENJAMIN1 SUTTON was born circa 1752 in Dobbs
County, North Carolina ( Deed.); Moses Westbrook to Benjamin Sutton.
He married Sarah Hardy, daughter of William Hardy and Sarah Sowell, circa 1777.
He died in 1837 in Lenoir County, North Carolina
(Estate of Benjamin and Sarah Hardy Sutton, Found in John Heritage Bryan
Collection and in the Re-registered Deeds of Lenoir
County.); The estate records state he had a will in 1837 and that his wife
Sarah died in 1846 after the spring.
It is family tradition that his middle name was Oxley but there is nothing to
support it and the use of middle names during this period
was unusual. It is also family tradition that Sarah was a Hardy. That much is
probably true but is not proveable, much less who her
parents were. If Sarah was the daughter of William and Sarah Sowell Hardy of
Bertie County, the Benjamin was her 2nd husband and
she was his 2nd wife and his oldest children were by another wife.

The above deed proves that Benjamin was the son of John. There is no entry in
the Cross Indices for a land transfer between William
Waddle to John Sutton. There does not appear to be another John with a son
Benjamin to which this deed could apply although the
transfer of the land was at least 12 years after the death of John Sutton I.
2. I Benjamin Sutton of County of Dobbs firmly bound to John Herring 1000 lbs
24 August 1791
In consideration of above obligation the said Benjamin Sutton made an entry in
land office for 350 acs land in Bucklesbury on ES Bear
Creek in Dobbs County. If a grant is obtained for land by virtue of said entry
and the said Benjamin Sutton doth within two months
after it is obtained make and asign unto John Herring a lawful deed of sale for
all the grant covers lying above the land formerly
surveyed and held by John Sutton now the property of Benjamin Sutton which deed
is to include the land formerly held by John

for several items among others - tobacco and blue
flannel. Received 15 April 1803 or 1808 of Benjamin Sutton one lb 17 shillings
in full of John Sutton Jr.
This above deed indicates that John Sutton Jr. (the younger) was the son of
Benjamin who was paying his bill.

SARAH HARDY was born on 12 April 1759 in Bertie County, North Carolina
(William Hardy Family Bible, (Copy of original at
Heritage Place, LCC).) (William Hardy Estate, Bertie County, 1793.). She died
in 1846 in Lenoir County, North Carolina (Estate of
Benjamin and Sarah Hardy Sutton.).
The William and Sarah Sowell Hardy Bible was removed from Bertie to Lenoir
County indicating someone had inherited it and
moved. The estate of William Hardy proves his daughter, Sarah, married a
Sutton, but not which one. It has been written that Sarah,
daughter of William married Ephraim White in 1780 and there are Marriage Bonds
for that couple, but I have always felt Benjamin
Sutton's wife was a daughter of William and Sarah Sowell Hardy. The last entry
in the Hardy Bible is the marriage date for Jesse
Hardy and Sarah Sutton. Duplin County Deeds prove that Sarah was the daughter
of Benjamin and Sarah Hardy Sutton. Since Jesse
Hardy was not a son of William, it can only be assumed that the Bible went from
William and Sarah Sowell Hardy to their daughter,
Sarah, who married Benjamin Sutton, and then on to their daughter, Sarah, who
married Jesse Hardy. The Bible is presently in Lenoir
County. All of this fell into place when the deed was discovered in Duplin
County in October, 2001.

There is a small letter in the Clellon Sutton papers I have always found
intriguing, though not conclusive
"Sally, you wrote to us that Ben was Draughted but was not able (torn edge)
march. I should be very glad to know whether he is gone
(short word scratched out) or know (torn edge) ha ?? hole ?? not ?? heard
nothing from you since. I expect to be Draughted now soon
but God only knows whether I shall or not Sept 22nd 1790 (here a
mostly-illegible word of about 3 letters that might be sis or sir or
something else) This is to let you know that I remain yr loving Brother till
death

The Census reports are consistent in supporting two sons of Benjamin, one of
whom appears not to
have married. One son is not with his mother on the 1840 Census indicating he
either died or moved
away. The Duplin County Deeds clearly indicate Benjamin had a son William yet
we can't find that
William on any census, so for the time being, we are giving this previously
unnamed son the name of
William. I suspect that William was the 2nd son.

heirs together. Was Alfred also an heir of the same person. We know that Alfred
married a daughter of
Benjamin and Sarah Hardy Sutton, and we know that Benjamin dc 1837. I have no
son by the name of
William for Benjamin and Sarah but do have an unamed son who appears in their
household in 1830
and not in 1840 and I assumed he died at that time. Certainly William Sutton
and Jesse Hardy were
heirs together giving more circumstantial that Jesse Hardy's wife was the
daughter of Benjamin and
Sarah Hardy Sutton.

Nancy, daughter of
Benjamin but the age is right. There is no Nancy on the 1850 Census.

2. ELIZABETH2 SUTTON (Benjamin1) was born in Lenoir County, North Carolina
(Ibid.). She married Alfred Ellis (Ibid.).
I have not been able to locate them on any Lenoir County Census Reports. The
information on their children was sent to me by Joy
Blankenship - JOY530@aol.com - from a file posted by Dr. Purdom at IN Univ.
Dr. Purdom gives his father as Jacob or John Ellis, born in Wales, and lived in
Md.
He has Alfred on the 1820 Census - three males 0-10, one 26-45; one female
10-16, one 16-26. He was on the 1850 Lowndes County,
Mississippi Census in 1850.
ALFRED ELLIS was born circa 1794.
Anyone have any info on John Ellis of Lenoir County, d. about 1815? Three sons,
John W., Alfred, Edwin, b. 1790's. Son Edwin was
my great-grandfather who died in Georgia, 1848. I'm searching for the name of
John's wife and his father. I believe his father was
Edwin Ellis of Greene County, N.C.
Alfred Ellis was a member of Sandy Bottom Church.

All of my information about the children of Alfred Ellis and Betsy Sutton
comes from information that my grandmother got -- most
of which came from her father-in-law John Alfred Ellis, who was the grandson
of Alfred and Betsy Sutton Ellis.
Acording to Sybil Hyatt, some of this family went to Mississippi.

4. JOHN2 SUTTON (Benjamin1) was born in Dobbs County, North Carolina,
circa 1779 (1840 Lenoir Co, NC Census.) (1850,
Lenoir Co, NC Census.). He married Elizabeth (Sutton) (Will of John Sutton,
written 5 June 1850, probated March Term, 1858,
contested and copy of Will found in John Heritage Bryan Collection, UNC,
Southern Historical Collection.). John died circa March
1858 in Lenoir County, North Carolina (Ibid.).
Elizabeth is not the proven mother of his children but she does appear to be
his only wife. Her surname is not known, but I suspect she
was an Aldridge. Their second oldest son appears to have been John A. Sutton
and the A. probably stood for Aldridge.
The John Sutton Jr. on the 1844 Lenoir County Tax List, Bearcreek District with
8 blacks, 686 acres worth $3630 and also 607 acres
worth $1214 may be this one. Or it could be John Sutton in the Kinston District
- 7 blacks, 696 acres worth $1392.
WILL OF JOHN SUTTON OF LENOIR COUNTY - 5 June 1850
In the name of God, Amen - I, John Sutton of the County of Lenoir and State of
North Carolina being of sound disposing mind and
memory blessed be God for the same, do constitute, publish and declare this
instrument to contain my last will and testament in manner
and form following that is to say (viz)
First - That my executor herein after named shall provide for my body a decent
burial, and pay all funeral expenses, together with my
just debts, howsoever and to whomsoever owing out of the moneys that may first
come into their hands as part or parcel of my estate
Item 2nd - I lend unto my beloved wife Elizabeth Sutton during her natural life
the following property (viz) one half of the cleared land
that is one the plantation whereon I now live with full privilege of getting
fire wood and train timber on any part of said land whereon I
now live. Also the following named negro slaves (viz) George, Lydia, Lovecy,
Edith, Emmy, Moris, Jack, Penny, Sam, Eliza, America,
Fanny, Elly, and Henry. Also two horses, two cows and calves, four sows and
pigs, ten head of sheep, all her choice, all of the
household and kitchen furniture, not hereinafter otherwise devised. Also one
hundred barrels of corn, ten stacks of blade fodder, three
thousand pounds of green pork if on hand, if not bacon sufficient for one
year's support for herself and family to be laid off by my
executors and a plentiful support of every other article, necessary for one
year's support such as sugar, coffee, flour, molasses, to be
laid off by my executors - All necessary farming tools for a two horse farm and
all the poultry of every description. And my will and
desire is, at the death of my beloved wife Elizabeth Sutton, that all the above
named negroes loaned to her and all their future increase
from this day on also all the above named property of every description loaned
to my wife except the land shall be equally divided into
four shares in the following manner (viz). I lend unto my daughter Martha
Heath, during her natural life - one fourth part of all the
above named property loaned to my wife except the land, and at the death of my
said daughter Martha Heath, I give all the property so
loaned to her to be equally divided between all her children and their heirs
and assigns forever. And I also lend unto my daughter
Avey Allen, during her natural life, one fourth part of all the property loaned
to my wife in this clause except the land. And in the
death of my said daughter Avey Allen, I give all the property so loaned to her
in this clause to all her children to be equally divided
between them, their heirs and assigns forever. And also I lend unto my
daughter Mary Gray during her natural life one fourth part of
all the property loaned to my wife in this clause except the land and at the
death of my said daughter Mary Gray, I give all the property
so loaned to her in this clause to all her children to be equally divided
between them their heirs and assigns forever. I give unto my
three grand children Dempsey Wood, Jesse Wood, and Harriet Eliza Wood the
remaining one fourth part of all the property loaned to
my wife except the land with the following stipulations, condition and proviso,
first: I direct that a Guardian shall be appointed to take
charge of their property and the negroes to be hired out by the Guardian until
my said grand children, Jesse, Dempsey and Harriet E.
Wood shall arrive at lawful age or marry - Provided now if either one of my
said grand children shall die before arriving at lawful age
or marriage I desire the surviving one or ones shall have the whole of the
property or if either one of my said grand children, Jesse,
Dempsey and Harriet E. Wood shall die without leaving any heir lawfully
begotten of their body, I desire the surviving ones to have
the property of the deceased one leaving no children - provided further now in
case if all of my said grand children, Jesse, Dempsey,
and Harriet E. Wood should die without leaving any heir lawfully begotten of
their body, I devise that all their property hereby devised
to them in this clause shall be equally divided between all my children to
them, their heirs and assigns forever.
Item 3 - I give and bequeath unto my son Josiah Sutton my plantation whereon he
now lives containing two hundred and fifty acres
more or less adjoining the lands of the heirs of William Gray dec and others to
him and his children in fee simple forever. I also give
unto my son Josiah Sutton one negro girl named Delsey, to him his heirs and
assigns forever
Item 4 - I give and bequeath unto my two sons John Sutton and Benjamin Sutton
the whole of my lands on the South side of Neuse
River, which lands I purchased of William B. Edmundson. John Sutton is to have
the upper part of said land, whereon he now lives to
the dividing line which I made in said lands for a dividing line between John
and Benjamin Sutton must have from said division line, it
being the lower part of said tract of land to them, their heirs and assigns
forever. Also I give unto my son, Benjamin Sutton, one
thousand dollars in cash, to him his heirs and assigns forever.
Item 5th - I give and bequeath unto my two sons Jeremiah Sutton and Hardy
Sutton the whole of my land where I now live to be
equally divided between them. Hardy Sutton must have the upper part of the
plantation including my dwelling house and outhouses
and my will and desire is that if either one of my sons, Jeremiah or Hardy
should die without leaving an heir lawfully begotten of his
body, I desire the surviving one to have the whole of the land given in this
clause. I also give Jeremiah Sutton one negro boy named
Aaron, one bed, bedstead and furniture and also one thousand dollars in cash to
him, his heirs and assigns forever. I also give my son
Hardy Sutton one negro boy named Abram, one bed and furniture and bedstead and
five hundred dollars in cash to him, his heirs and
assigns forever.
Item 6th - I lend unto my daughter Mary Gray during her natural life four negro
slaves with all their present and future increase, named
Dolly, Bryant, Alsey and Bob. After the death of my said daughter, Mary Gray,
I give all the above loaned negroes and their present
and future increase from this day to be equally divided between all the
children of my said daughter Mary Gray to them, their heirs and
assigns forever.
Item 7th - I lend unto my daughter Avey Allen during her natural life the
following named negroes (viz) Liz, Charles, Celia, Abram,
Edney and all their present and future increase and fter the death of my said
daughter Avey Allen I give all the above loaned negroes to
and all their present and future increase from this day to be equally divided
between all the children of my said daughter Avey Allen to
them their heirs and assigns forever.
Item 8th - I lend unto my daughter Martha Heath, during her natural life, two
negroes named Sam and Peter. After the death of my
said daughter Martha Heath, I give said Sam and Peter to all her children to be
equally divided between them their heirs and assigns
forever.
Item 9th - I give and bequeath unto my three grand children, Dempsey Wood,
Jesse Wood, and Harriet Eliza Wood, the following
named negroes (viz) Daniel, Rose, Leah and all their present and future
increase with the following conditions stipulations, and proviso
in this clause, provided now if either one of my said grand children should die
without leaving any heir lawfully begotten of their body,
I desire the surviving ones to have the whole of the property devised in this
clause, provided further now in case all my three grand
children, Jesse, Dempsey and Harriet E. Wood should die without leaving any
heir lawfully begotten of their body - My will and desire
is that all the property devised in this clause shall be equally divided
between all my children, to them their heirs and assigns forever.
All the above named negroes devised in this clause are now in the possession of
James Wood. I direct and request my executors
immediately after my death to take said negroes and hire them out either
private or public for the benefit of my said three grand
children until a guardian shall be appointed for them.
Item 10th - My will and desire is that all the rest and residue of my estate
after taking out the devises and legacies above mentioned,
shall be sold and the debts owing to me collected and if there should be any
surplus over and above the payment of debts and legacies
that such surplus shall be equally divided and paid over to my wife and all my
children in equal proportion share and share alike to
them and every one of them, their heirs and assigns forever.
Lastly - I hereby nominate, constitute and appoint my son Benjamin Sutton and
my trusty friend Council Wooten my lawful executors
to all intent and purposes, to execute this my last will and testament
according to the true intent and meaning of the same, and every
part and clause thereof, hereby revoking all other and former wills by me
heretofore made.
In witness whereof I the said John Sutton do hereunto my hand and seal due the
5th day of June A.D. 1850.

Humbly complainant showeth unto your Honor that
John Sutton late of the county aforesaid departed
this wife on the (blank) day of 185(blank) having duly made and published his
last will and testament in writing bearing date on or
about the 5th day of June 1850 which was executed and attested as by law is
required to both real and personal estate of which the
copy to here to annexed marked (appears to be a mark in the shape of a B)
is to true copy and which your orator prays may be taken or a part of his will
and your orator further showeth unto your honor that the
said testator departed this life without altering or remaking his said will
leaving the said defendants Elizabeth Sutton his wife - or
widow and Martha Heath, Avey Allen, William Gray & his wife Mary his daughters,
Dempsey Wood, Jesse Wood & Harriett Eliza
Wood - the ? last infants under the age of twenty one his grandchildren, Josiah
Sutton, John Sutton, Benjamin Sutton, Jeremiah Sutton
and Hardy Sutton his sons, his only heirs at Law.
And your
orator further Showeth unto your Honor that the said testator in and by his
said will appointed his son Benjamin
Sutton and your orator executors to his said will and that your orator alone
qualified as executor and duly proved the said will in the
county court of Lenoir at the March Term thereof AD 1858 and took upon himself
the executors thereof and passes himself of the
personal estate and effects of his said testator to a great amount. And your
orator further showeth unto your Honor that as to the real
estate and in fact as to ? devised and bequeath in said will mentioned there is
no contention or deversity of opinion amongst the said
defendants with reference to the intention of the said testator - or as to the
proper construction and meaning of said will except the
negroes and the provision of the property in the --- as mentioned and set forth
in the 9th line of said will
given and bequeath as follows - to wit
Item (9th - I give and bequeath unto my three grand children, Dempsey Wood,
Jesse Wood, and Harriett Eliza Wood the following
named negroes viz Daniel, Rose, Leah and and all their present and future
increase with the following conditions stipulations, and
proviso in this clause, provided now if either one of my said grand children
should die without having any heir lawfully begotten of
their body, I desire the surviving ones to have the whole of the property
devised in this clause provided further now in case all my three
grand children Jesse, Dempsey and Harriet E. Wood should die without having any

desire is that all the property devised in this clause shall be equally divided
between all my children to them, their heirs and assigns
forever. All the above named negroes devised in this clause are now is the
possession of James Wood. I direct and request my
executors immediately after my death to take said negroes and hire then out
wither private or public for the benefit of my said three
grand children until a guardian shall be appointed for them.
--- orator is willing to settle estate but has been prevented from so doing
--- because of the conflicting claims of the defendants as to
what was to be divided. James Wood is the father of the said children and
married Betsy, daughter of the testator --- who departed
before the testator - James Wood has been appointed guardian of the children
--- James Woods claims the Negroes are his property
since they were put in his possession by the testator before he deceased and
they were an advancement to him or his deceased wife -
and the other defendants say the negroes belong to the children.
Since the death of the testator James Wood has had the control of said
negroes -
Your orator has tried to get all to settle their differences and the estate
has not been able to be settled ---
Your orator wishes it to be decided by the court if the will is valid so the
estate can be settled.

B. Taylor 11, R. B. Vause 12 sworn and
impanneled to try the issues made in this cause, upon their oaths say that the
said paper writing and every part thereof is the last will
and testament of the said John Sutton. It is therefore considered by the Court
that the said paper writing be duly filed and recorded as
the last will and testament of the said John Sutton - It is further considered
that the said C. Wootin Executor do recover against the said
Jesse Wood, Dempsey Wood and H. E. Wood his cost of suit and thereupon the said
c. Wooten one of the executors as aforesaid
named in said will, duly qualifies as such by taking the oath required by law.

Blaney Allen was deceased by the 1860 Census. There are several children on
both the 1850 and 1860
Census that do not appear to be children of Avey as they are too old. Her will
only mentions two
children, Fannie W. and Flavius Allen, plus her son George L. Capell. On the
1850 the other children
are listed as being Allens but on the 1860 Census they are listed as Gray's.
They might be the Gray
children of her sister. At some point, she remarried G. W. Capell who died
before she did.

5. THOMAS2 SUTTON (Benjamin1) was born circa 1782 in Dobbs County, North
Carolina. He married Unkown (--?--). He died
between 1850 and 1860 in Lenoir County, North Carolina.
The Census supports another son for Benjamin who lived in his household until
Sarah died. On the 1850 Census a Thomas appears,
aged 68. On the 1840 Census is a young male in the household of Sarah and in
the household of Thomas on the 1850 Census is an Ivey
Sutton the same age. This indicates Thomas could have married late in life, had
one child and his wife died and Ivey was his son.
There is nothing to support Ivey being a grandson at this point. This is
speculation, of course, but for the time being, Thomas is being
placed as a son of Benjamin and Sarah and Ivey his son.
It is also possible that Thomas lived in Duplin Co for awhile.

8. WINIFRED2 SUTTON (Benjamin1) was born circa 1789 in Lenoir County, North
Carolina (Estate of Benjamin and Sarah
Hardy Sutton.). She married Joshua Barwick, son of Joshua Barwick and Mary
(Barwick), circa 1811 in Lenoir County, North
Carolina (Ibid.) (Alexander William Barwick Family Bible, (1955 in posession of
Miss Lela Barwick, Copy in "Dobbs County Bible
Records" by William Murphey Vol 11).). She died on 11 July 1871 in Lenoir
County, North Carolina (Ibid.).
This family appears to have lived on the border of Wayne, Lenoir and Duplin
Counties and have records in all three counties. They
were on the 1850 Census of Lenoir County and it is assumed they died there.
Both may be a few years older than the 1850 Census
indicates.
JOSHUA BARWICK was born circa 1789 in Dobbs County, North Carolina. He died on
17 April 1851 in Lenoir County, North
Carolina (Ibid.).
There are two later entries in the Bible for two children of James M. and
Rachel Rich but they have not been identified at this point.
There is no proof that Joshua was the son of Joshua I.

The below document in the Noah Rouse Collection at Duke proves that Benjamin
had a son Benjamin.
Court document: Benjamin F. Sutton, exec. of Hardy Sutton had petitioned the
court (Fall term 1868, Superior Court, Lenoir Co.) to
sell property belonging to Hardy Sutton to pay debts to the estate. Property
sold to Noah Rouse at auction as ordered. Amount
$10,000.05 Description: 874 acres NS Neuse River in Bucklesberry, adjoining the
lands of Josiah Sutton, Elizabeth Sutton, Jerry
Sutton, the heirs of William Grey and others (400 acres of the said land known
as the Uzzell tract was conveyed by John F. Wooten,
Clerk & Master in Equity of Lenoir County to the said Hardy Sutton deceased;
250 conveyed & devised to the said Hardy Sutton
deceased by his father Benjamin Sutton; and the remaining 224 acres was
conveyed to …Hardy Sutton by Benjamin Sutton his
brother)?Also, 450 acres of land on Neuse R and Bear Creek adjoining the
lands of Josiah Sutton, Franklin Herring, Dempsey Wood and others and separated
from the land above described by the lands of the
heirs of William Gray deceased known as the Frog Point tract and conveyed to
…Hardy Sutton by one Gregg Whitfield and wife. 12 April 1869
Two of Simon Herring's daughters married this Benjamin Sutton, Eliza and after
her death, Elizabeth after the death of her first
husband, John Barrow. We have no way of knowing who the mother of some of the
children were not knowing when Mary Jane Hines
died. Given the five year gap between Henry and Mary, it is assumed Mary was
the first child of Eliza Herring. Much of the work on
this family was done by Tory Sutton Helmon and Mattie Jolly.
According to Winnie Sutton Fields, Benjamin had nine sons in the Civil War at
the same time - several who were killed. His home at
White Hall was used as a hospital by the Confederate soldiers. Only the women
were left when Benjamin died.
Family tradition from several branches of the family state that one of
Benjamin's wives had a child not fathered by Benjamin and his
name was Levi. It is also stated that Benjamin divorced this wife who would
almost had to be his first wife. George's middle initial
was L. but it is not known what that stands for. The census indicates that
George was born CA 1852. Marjorie Oliver states that Levi
Sutton son of Benjamin married Sarah Adeline Sutton daughter of William Isler
Sutton of the John Jr. line. Indeed a Levi and his wife
Sarah Adeline are buried at Fairview in LaGrange; however, the birthdate on the
stone is 15 December 1838. Benjamin did not name a
son, Levi, in his will, but he did name George L. For the time being I have
placed Levi under Benjamin but there is some question as
to whether he was a blood child.

common of the lands devised to them by the last will
and testament of Benjamin Sutton, dec'd. whereupon, we have made and do hereby
make the following appropriations among the
respective claimants in severally, that is to say:
The Lot No. 1 is assigned and appropriated to George L. Sutton bounded as
follows: beginning at a stake on the bank of the Neuse
River to a stake near the public road, to a branch, then down the branch to
Daniel Sutton's corner, corner of lot #2, to Neuse River -
110 acres valued at One Thousand Dollars
The Lot #2 - is appropriated to Jennett Turner bounded as follows: beginning at
the mouth of the Mill Branch, up the run of the same
to the public road,, with the canal, adj Lot #1, to a stake near the gin house,
to the Neuse River - 79 ½ acres valued at One Thousand
Dollars.
Lot #3 is appropriated to Buck Sutton bounded as follows: beginning at the at
the run of the mill branch on the public road below the
mill and runs with said road, corner of Lot 2, back to the public road - 90
acres valued at eight Hundred and fifty dollars.
Lot #4 - appropriated to Louisa Davis - beginning at Blount's line, to Daniel
Sutton's line, corner in Lot 1, corner in Lot 3 - containing
97 acres valued at Thirteen Hundred & Fifty Dollars
Lot #5 - is appropriated to Eli Sutton - Blount's line, corner of Lot #4, edge
of sand ridge - 151 acres valued at nine hundred and fifty
dollars
Lot #6 - appropriated to Benjamin H. Sutton - corner of Lot #5 to the sand hill
or high land, Daniel Sutton's land, corner of Lot #4 -
238 acres valued at nine hundred and fifty dollars
Lot #7 - appropriated to Allen Sutton - Blount's line, Guinna Spring, Great
Baer pocosin - two hundred and thirteen acres valued at
nine hundred dollars
We further charge the more valuable dividends with such sums of money
respectively to be paid to those of inferior value respectively
as will make an equitable division, that is to say:
That Lot No 4 appropriated to Louisa Davis is to pay to the Lot No 3
appropriated to Buck Sutton the sum of one hundred and fifty
dollars
That lot No 4 appropriated to Louisa Davis is also to pay to Lot #5
appropriated to Eli Sutton the sum of fifty dollars.
Lot No 4 appropriated to Louisa Davis is also to pay to Lot No 6 appropriated
to Benjamin H. Sutton the sum of Fifty Dollars.
Lot No 4 appropriated to Louisa Davis is also to pay to Lot No 7 appropriated
to Allen Sutton the sum of One Hundred Dollars.
One acres of land where the gin house and cotton screw is now located which has
not heretofore been appropriated is appropriated to
Lot No 1 with all improvements thereto or in anywise belonging the value of
which is includedin the valuation of the said Lot No 1
appropriated to George Sutton.

In the name of God, Amen. I, Benjamin Sutton, Sr., of Lenior County, and
State of North Carolina, being of sound mind and
disposing memory but calling to mind the uncertainty of death, do make, ordain
and establish this my last will and testament in manner
and form following, viz.: That is after my death for my body to be buried in a
decent manner and my funeral expenses and just debts
be paid according to law, by my executor hereinafter named.
Item 1. My will and desire is that the marriage settlement
between my wife ELIZABETH SUTTON and myself shall stand without
any ammendments, as agreed upon by us as reference to said paper writing will
fully show.
Item 2. I give and bequeath unto my daughter NANCY DAILY,
WIFE OF GEORGE DAILY, to her and her heirs forever, the
following named negro slaves, viz.: Lettis, Mill, Mariah, Bob, Jenny, Hester,
and all their increase, and also all the other property I
have heretofore given, which she has in her possession.
Item 3. I give and bequeath unto my son DANIEL SUTTON and his
heirs forever, one certain tract of land; Beginning at a dead
pine on the dividing branch and runs North 176 poles to a stake, then South 73,
East 41 poles to a stake, then North 365 poles to a
stake, then West 65 poles to a stake, then South 348 poles to a sweetgum, then
West 53 poles to a stake, then South 150 poles to a
huckleberry on the run of the dividing branch, then down and with the run of
said branch to the beginning, containing two hundred and
thirty-six acres more or less, and all the other property I have heretofore
given him, which is now in his possession.
Item 4. I give and bequeath unto my son WM. SUTTON and his heirs
forever one tract of land which that I bought of Alfred Ellis
on the South side of Neuse River which said tract of land I have heretofore
given William a deed for; also on this day William's own
note for Seven Hundred and Thirty-Five Dollars together with all the other
property which I have heretofore put him in possession to
him and his heirs forever.
Item 5. I give and bequeath unto my daughter SARAH BIZZELL, WIFE
OF JOHN J. BIZZELL and her heirs forever the
following named negro slaves and their increase, viz.: Isaac, Mariah, James,
Jess, Eveline and Abram and all the other property which I
have heretofore given her, which she has in her possession.
Item 6. I give and bequeath unto my daughter CHLOE M. PARKS, WIFE
OF JOHN PARKS, and her heirs forever, the following
named negro slaves, viz.: Needham and Amanda, also, five hundred dollars,
which sum I have already paid her, and all the other
property I have given her, which she has now in her possession except the negro
girl Amanda.
Item 7. I give and bequeath unto my son THOMAS SUTTON and his
heirs forever one tract of land known as the upper part of the
lands I bought of Jesse Pipkin lying in Wayne County; Beginning at a
huckleberry tree on the run of the dividing branch, my son
Daniel Sutton's corner of the lands I gave him, and runs with his line North
150 poles to a stake, then East 53 poles to sweetgum, then
North 348 poles to a stake, then West 81 poles to a stake, then South 258 poles
to two water oaks, then South West about 100 poles to
the run of the dividing branch, then down and with said run to beginning
containing two hundred eighty five acres more or less, and all
the other property which I have heretofore put him in possession.
Item 8. I give and bequeath unto my two grandsons THOMAS H.
and WM. H. SUTTON, children of deceased son Daniel (should
have read HENRY) SUTTON, two thousand dollars to be equally divided between to
them and their heirs forever.
Item 9. I give and bequeath unto NANCY SUTTON, widow of my
deceased son, HENRY SUTTON, five hundred dollars to her
and her heirs forever.
Item 10. I give and bequeath unto my daughter MARY HINES, WIFE
OF IRA D. HINES and her heirs forever, two negro slaves
viz.: Jenny and Florence, and all their future increase, one bed, bedstead &
furniture which she now has in her possession.
Item 11. I give and bequeath unto my daughter WINNEFRED J.
FIELDS, WIFE OF ELIJAH FIELDS and her heirs forever, two
negro slaves viz.: Mariah & Hardy, and all their increase, one bed, bedstead &
furniture and two cows & calves.
Item 12. I give and bequeath unto my sons ALEXANDER SUTTON and
FREDERICK SUTTON the whole of my tract of land to
be equally divided between them, which tract of land I bought from Worry
Kilpatrick said land is on the South side of Neuse River,
and on each side of Moseley's Creek adjoining the lands of Worry Kilpatrick and
others containing about 600 acres more or less to
them and their heirs forever. Also two beds & furniture, two horses, four cows
& calves, four sows & pigs, to be equally divided
between them.
Item 13. I give and bequeath unto BENJ. H. SUTTON, ALLEN W.
SUTTON, GEORGE L. SUTTON, JENNETT SUTTON,
ISAAC E. SUTTON, LOUISA R. SUTTON and JAMES B. SUTTON all my lands not
heretofore given away to be equally divided
between them, and their heirs forever. Also the whole of the negro slaves not
heretofore disposed of except old Jenny, to be equally
divided between the above named seven children share and share alike to them
and their heirs forever. Also the sum of five hundred
dollars not otherwise disposed of to be retained by my son THOMAS SUTTON for
the support and maintenance of old negro Jenny
during her life.
Item 14. I desire as soon as practicable after my death that
my hereinafter named Executors do make sale on a credit of six months
of all my crop, stock, "grate" house & kitchen furniture, and everthing not
heretofore disposed of, and the money arising from said
sales after paying all the legacies expressed in this my will, together with
all the debts which may be due me at my death and money in
hand if there should be anything over to equally divided among my seven
youngest children, except ISAAC ELI SUTTON, must have
five hundred dollars more than the other six named children on account of his
lameness.
Item 15. And lastly I hereby nominate and appoint my two sons
WM. SUTTON and THOMAS SUTTON my true and lawful
executors to this my last will and testament utterly revoking and forever
disannulling all other will or wills by me heretofore made,

proved by the oath and examination of Allen W. Wooten and A. W. Barwick the

considered by the Court that the said paper writing and every part thereof is

married Chloe A. Hines, daughter of Isaac Hines and Barbara Hardy, on 23 August
1873 (Ibid.). He
died on 11 July 1894 in Wayne County, North Carolina, at age 72 (Will of
Benjamin Sutton, written
13 August 1863, probated September 1864, copy found in Wayne County, NC.)

Grove Cemetery,,
Wayne County, North Carolina.
According to his sister, Winnie, he was a private in the Civil War.
His two wives are stated to be sisters, children of Isaac and Barbara Hardy
Hines. Chloe is in the
household of Barbara on the 1850 Census but the name Isaac does not appear in
the Bible and some
say they were children of Daniel. One Daniel Hines' death appears in the Bible
and it was just before
the 1850 Census.

iii. WILLIAM SUTTON was born on 15 January 1824 in Lenoir County, North
Carolina (Estate of

December 1841.
He married Wealthy Catharine West, daughter of Kinnion West and Teresa (West),
on 1 February
1863 (Ibid.). He died on 30 August 1872 in Lenoir County, North Carolina, at
age 48 (Estate of
Benjamin Sutton.) (Will of Benjamin Sutton, written 13 August 1863, probated
September 1864, copy
found in Wayne County, NC.) (Tombstone.).
According to his sister, Winnie, he was a Captain in the Civil War, in the
artillery and stationed at Fort
Fisher.
Mattie Jolly has done extensive research on this family and has shared a few of
the family documents
with me including a picture of William and his second wife, Wealthy Catharine
West.
Among the items she sent was from the Bible of William and Wilma Sutton owned
by Mrs. Marie
Sutton Scott which gives the children of William and Wilma as
Mary S. b 12 May 1843
Ben b 26 Nov 1844
Lottie b 14 August 1846
William G. b 17 Nov 1847 (his middle name was Edward and his birthdate does
not agree with his
Bible)
Nancy C. b 15 Dec. 1849
James b 31 Oct. 1851
William served in the House of Commons during 1850, 1851, 1854. He was involved
in bringing the
railroad through Lenoir County. He served in the Civil War but he returned home
after the death of his
wife and daughter tendering his resignation on 25 September 1862 from Fort
Fisher. He had been
captured and taken to Governor's Island and then sent to Fort Warren in Boston
where on 11 June
1862 he was paroled for exchange.
William was known as "Pony Bill", was a Mason which saved his home from being
destroyed during
occcupation by a Yankee Mason.
He reared his father's youngest children after his father died. It is not
exactly clear on the 1870 Census
who all the people in his household were - his children or siblings.
The below are copies of original documents in Mattie Jolly's possession.

husband as Captain of the "Lenoir Braves" who was captured by the Federals at
"Cape Hatteras" the

Any receipt signed or given by him for the sale shall be as binding on me as if

married Sarah Adeline Sutton, daughter of William Isler Sutton and Sarah

buried in Fairview
Cemetery,, Lenoir County, North Carolina.

child of Benjamin but
appears to be a blood child of Mary Jane.

ELIZA HERRING was born in Lenoir County, North Carolina (Estate of Simon

She died circa 1857 in Lenoir County, North Carolina; Based on the death date
of her brother-in-law John Barrow and the remarriage
of her sister, Betsy, to Benjamin Sutton.

County, NC.).
From information that Mattie Jolly gave me from various sources is quoted a
letter from Mrs. J. H.
Thompson in 1958 - "Mary Sutton Hines was my grandmother and Benjamin Sutton
her father. My
mother and father were first cousins so that makes Benjamin Sutton my great
grandfather on both my
mother and father's side. My father's mother was Mary Sutton and my mother's
father was George
Sutton and Mary and George were brother and sister.

ii. ALEXANDER SUTTON was born circa 1841 in Lenoir County, North Carolina
(Ibid.). He died circa
1864 in Richmond,, Virginia; CSA - died during the war as a result of fever in
Richmond.
According to his sister, Winnie, he was called Alec and was a private in the
Civil War. He was
captured and imprisoned, while in a Yankee prison he had a severe attack of
fever, was parolled but
was so weak he died in Richmond while on his way home.
The Sutton Letters indicate he may have married before going to War and his
wife was named Ann.

Resided in Lenoir County where he enlisted at age 20, April 25, 1861.
Captured at Bristoe Station, Virginia, October 14, 1863. Confined at Old
Capitol Prison, Washington, DC, until transfered to Point Lookout and

February 14-15, 1865, for exchange.

iii. JOHN W. SUTTON was born circa 1843 in Lenoir County, North Carolina. He
died circa 1864; CSA
- died during the war of a hemorage caused by excessive heat.
According to his sister, Winnie, John was the only brother who died during the
Civil War who was
brought home to bury.

iv. WINIFRED J. SUTTON was born on 10 March 1844 in Lenoir County, North
Carolina (Estate of

Fields and Christian
Williams Smith, on 14 March 1861 in Lenoir County, North Carolina. She died on
6 May 1923 in
Lenoir County, North Carolina, at age 79.
RECOLLECTIONS OF WINNIE FIELDS
My husband, Elijah Fields, fought through the Civil War, was a volunteer in the
61st Regiment,
Company E, Clingman's Brigade, Captain Byrd.
From Enlistment to surrender he never had a furlough, was in many of the
hardest battles of the war,
several times had holes shot in his clothing; but was never wounded.
He was with his regiment in the battles at Fort Sumter, James Island, Kinston,
Williamston, Plymouth,
and Tarboro in his own state; also at the front at Gettysburg, Sharpsburg,
Petersburg and for a long
time was near Richmond, Va.
He was captured once in Virginia but was recaptured before he was imprisoned,
he saw and shared all
the hardships that fell to the lot of the Confederate Soldiers.
Have heard him tell how they once had to march barefoot in the snow, suffered
from hunger, cold,
slept on the ground, sick and weary but never thought of giving up the
struggle, and in the four years
of hardship never saw me or his baby daughter.
At the time I had nine brothers in the Confederate Army, the oldest Capt.
William Sutton was an
artillery man and was stationed at Fort Fisher. Seven were private soldiers in
Lee's Army. They were:
Tommie, Daniel, Henry, Alec, John, Fred, and Levi Sutton. My youngest brother,
Ben Sutton, joined
the State Guards near the close of the war, he was only a boy when he enlisted.
Fred was captured by
Yankees while he was sick with measles and died of exposure, was buried in New
Berne in an
unmarked grave.
Henry was left with the dead in the slaughter at Gettsysburg, John died of
hemmorhage caused by
excessive heat after a forced march with his company, he alone was brought home
and interred with
the family.
Brother Alec was captured and imprisoned, while in a Yankee prison he had a
severe attack of fever,
was parolled but was so weak he died in Richmond while on his way home, like
thousands of others
who died in his day he lies in an unknown grave.
My father's home at White Hall was used as a hospital by the Confederate
soldiers while they camped
in that section. I spent my time there while my husband was fighting for his
country, and am glad to
remember that we did all in our power to relieve the sufferings of the
unfortunate ones.
My father died in '64, as all his sons were in the war, it left all the women
and children in the family at
his home without protection and as the Yankees had destroyed everything they
could find, we went
through suffering and endured privations that the younger generation and those
of our own time, who
lived in sections where they never saw real war, can never realize. Even now
when it has been a
memory for 50 years the very thoughts of it all make me know that the Civil War
will never be over
until all of us who lived through its hardships and injustices can forget it in
death.

Winnie refers to him as her youngest brother but he was not the youngest son.
It is possible that he was
he youngest whole brother but there is no evidence that Elizabeth Herring
Barrow had any Sutton
children.
Mrs. Essie Simmons gives her maiden name as Carter. Their children given as
James whose son Jim
md Eliza Rouse of LaGrange, Bill who married a Moye, Charles, Lou who md Ben
Moye, and Nannie
who md Charlie Garris.

Skinner, Ina, Eva, Lilla and India who married a Jarman. Allen married 2nd a
cousin of Sarah's. Mrs.
Simmons in other information gave his middle name, and dates. She also gives
his 2nd wife as Pussey
Ann Grady.

the Davis and Lathinghouse first names. The year for the birth of Louisa and
Isaac - one is wrong as

xii. JAMES BUCHANAN (BUCK) SUTTON was born on 28 December 1856 in Lenoir
County, North
Carolina (Will of Benjamin Sutton, written 13 August 1863, probated September
1864, copy found in
Wayne County, NC.) (Estate of Benjamin Sutton.). He married Nancy S. Waller,
daughter of Haywood
Waller and Charlotte Grady, on 28 October 1875. He died on 23 January 1915 in
Florida, at age 58.
He was buried in Walton County, Florida.
According to Harvey Fleming who supplied some of this information, Buck
went to Georgia and
then to western Florida, Santa Rosa County in 1900. He was in the turpentine
business. His oldest son,
Haywood, was the first sheriff of Okaloosa County.
Most of this information came from Mrs. Essie Simmons who put this together in
1957 along with
several other members of the family.

ELIZABETH (BETSY) HERRING was born on 3 March 1813 ( Collection of Ima
Eula Mewborn, Farmville, NC.). She married
John Barrow, son of John Barrow and Susan Herring, on 3 January 1826 (Ibid.)

Archives.). Elizabeth died on 31 December 1883 at age 70 (Collection of Ima
Eula Mewborn.). I have always seen Elizabeth as the 3rd
wife but the 1870 Census does not support the Elizabeth in the household of
Benjamin being this Elizabeth. She was 26 on the 1860
Census and the Elizabeth in the Sutton household was 67 according to Russell.
There were no known children of Benjamin2 Sutton and Elizabeth (Betsy) Herring.

11. HARDY2 SUTTON (Benjamin1) was born in Lenoir County, North Carolina,
on 17 September 1803 (Hardy Sutton Family
Bible.) (Will of Hardy Sutton, Copy of original Will at East Carolina
University, Joyner Library.). He married Anna Hill in North
Carolina, circa 1824. Hardy died on 10 April 1861 in Lenoir County, North
Carolina, at age 57 (Ibid.) (Tombstone.). He was buried in
Hardy Sutton Cemetery,, Lenoir County, North Carolina.
There are several people in the Bible whose relationship is not known. Mickey
Elmore has done a great deal of work on this line.

No further information as to the location but it probably came from the
Manuscript Collection, ECU, Joyner Library and this may be a
hand written copy of the original. This Will is re-recorded in Lenoir County at

WILL OF HARDY SUTTON, SR.
In the name of God, Amen, I Hardy Sutton Senr of the County of Lenoir and
State of North Carolina being of sound mind and
disposing memory but considering the worthy quality of my earthly existence do
make and declare this to be my last will and testament
in manner and form following that is to say
First That my executor herein after named shall provide my body a decent
christian burial suitable to the wishes of my relatives and
friends and my circumstances of life and pay all funeral expenses together with
my just debts howsoever and to whomsoever owing out
of the moneys that may first come into his hands as a part of my estate.
Secondly It is my will and desire that the property being negroes that I have
heretofore by deed of gift given to Dempsey Wood and
his children be his and theirs for them to hold and enjoy for their own use and
benefit and which said deed of gifts I do now in every
respect confirm and make it a part of this my Last Will Testament.
Thirdly I give unto my beloved wife Ann Sutton for her life or widowhood one
third of my home tract of land which shall include my
dwelling house and out buildings being one third of the land given me by deed
and by will of my father, Benjamin Sutton, deceased
and at her death or marriage it is my will and desire that it shall then go to
and I do hereby at that time devise and give the same unto
my well beloved son, Julius E. Sutton and his children forever.
Fourthly I give unto my well beloved wife Ann Sutton for her life or widowhood
the following negro slaves - old Chaney, Eliljah,
Hardy, Polly, Martha and little Save and at her death or marriage I give and
bequeath the said old Chaney, Elijah and Martha to my
well beloved son Lemuel H. Sutton and his children forever.
Fifthly I give and devise unto my well beloved son Julius E. Sutton all of my
home tract of land with the exception of the third thereof
herein before to and unto my wife Ann Sutton for her life or widowhood being
the land given me by deed and by will by my father,
Benjamin Sutton so that at the death or marriage of his mother he the said
Julius E. Sutton shall own the whole of my said home tract
to him the said Julius E. Sutton and his children forever.
Sixthly At the death or marriage of my wife Ann Sutton, I give and bequeath
unto my son Julius E. Sutton the negro woman Polly
before loaned to my wife for her life or widowhood and the increase of the said
Polly from this time forth to him the said Julius E.
Sutton and his children forever.
Seventhly At the death or marriage of my wife Ann Sutton, I give and bequeath
unto my beloved son Julius E. Sutton the negro slave
Little Save before loaned to my wife for her life or widowhood to him the said
Julius E. Sutton and his children forever.
Eighthly I give and devise unto my beloved son Junius E. Sutton all that
portion of my Uzzell tract of land that lies on the west side of
the Kinston and White Hall public road and on the Pinebrast ?? road and
adjoining the lands of Dempsey Wood and Joe L. Elmore and
my home tract to him the said Junius E. Sutton and his children forever.
Ninethly I give and bequeath unto my beloved son John A. Sutton all that
portion of my Uzzell tract that lies on the last side of the
Kinston and White Hall public road to him the said John A. Sutton and his
children forever being that of the Uzzell tract of land not
before given to my son Juius E. Sutton.
Tenthly I give unto my beloved wife Ann Sutton one bed, her choice and stead
and furnture and at her death or marriage I give the
said bed and stead and furnture to my son Julius and his children forever.
Eleventhly I give and devise unto my beloved son Thomas Sutton all of the
tract of land upon which he now lives being the land that I
purchased of Benjamin Sutton to him the said Thomas Sutton and his children
forever provided and on condition that he pays over to
my son Lemuel H. Sutton the sum of one thousand dollars with which payment I do
hereby charge said land. But if the said Thomas
Sutton should depart this life without leaving lawful begotten children
surviving then and in that went the said land shall be divided
unto two portions of one third and two thirds each and the one third portion
it is my will and desire that the wife of the said Thomas
Sutton, my beloved daughter in law Julia A. Sutton shall own and have for and
during her life or widowhood on condition and
provided that she the said Julia Ann Sutton shall never sell the same to any
one save and excepting to some of my own children and at
her death or marriage I give and devise it to my children to be equally divided
between them each to share and share alike and at the
death of the said Thomas Sutton without leaving lawfully begotten children him
surviving then the two thirds portion of said land it is
my will and desire shall be divided between all my children for them to share
and share alike.
Twelfthly At the death or marriage of my wife Ann Sutton, I give and bequeath
the negro slave Hardy before loaned to my wife for
life or till she married unto my beloved Thomas Sutton and his children forever
but if he the said Thomas Sutton should die without
leaving lawful begotten child or children, heirs surviving it is my will and
desire that the said Hardy shall be divided between all my
children for them to share and share alike.
Thirteenthly I give and bequeath unto my beloved daughter Nancy Wooten wife of
Joseph Wooten and her children forever the
following negro slaves vis Rachel, Mary, George, Wright, Hecter, Charity, Liah,
Albert child of Mary and their future increase and all
other property which I have before now put into her possession.
Fourteenthly I give and devise unto my well beloved son William H. Sutton all
that tract of land upon which he now lives and which I
bought of Wm J. Hunter to him and his children forever but provided and on
condition that he pays over to my son Benjamin F. Sutton
the sum of one Thousand Dollars which payment I do hereby charge said land.
Fiftenthly I give and devise to my well beloved son Lemuel H. Sutton and his
children forever one half of my Frog point tract of land
being the half upon which he now lives and the said tract to be divided
according to quately.
Sixteenthly I give and devise unto my well beloved son B. F. Sutton and his
children forever one half of my Frog Point tract of land
being the half other that above given to Lemuel H. Sutton and his children the
said tract to be divided according to quality.
Seventeenthly I lend unto my beloved son in law Joel Elmore for and during his
own life provided he does not outlive his present wife
my beloved daughter Martha Elmore and if he does so outlive her his said
present wife the said Martha Elmore there so long as she
does live the following negro slaves Margaret - rest on copy not readable -
---- present husband. The said Joel Elmore then and in the
event I lend all of the said negro slaves and their increase to her for and
during her own life and at her death I give and bequeath all the
said negro slaves and their increase unto her children by her present or future
marriage but to the exclusion of any child or children by
her had and bore by any former marriage.
Eighteenthly I give and bequeath unto my well beloved daughter Sallie H.
Sutton and her children forever the following negro salves
viz Mary, Gatsey and Arter and their future increase.
Ninettenthly I give and bequeath unto my well beloved daughter Louisa Sutton
and her children forever the following negroes slaves
viz Clarlsey, Avey, and Barbara child of Polly and their increase.
Twententhly I give and bequeath unto my well beloved daughter Christiana
Sutton and her children forever the following negroes
slaves to wit Lany, Charity and little Nice and their future increases.
Twenty firstly It is my will and desire that if any of my children sons or
daughters to whom I have given any portion of my property as
well lands as negroes should die without leaving lawful begotten children their
surviving the portions of there so ?? desire with the
exception of that given to my son Thomas Sutton for with regard to his portion
provision has already been made shall be equally
divided between my children for them to share and share alike as they would do
under our laws of distribution were I to die intestate.
Twenty secondly It is my will and desire that my executor here in after named
shall collect all the debts to me owing sell all my
perishable estate of all and every kind and species ?? and the following negro
slaves viz Nicey aged about forty three years, Alfred
Lucy ?? son aged thirty years, Jerry, Prince, Isac, George and Allen on such a
credit as to him may seem best and out of the proceeds
of said sale to pay all of my jut debts and funureal expenses and the surplus
if any it is my will and desire to be divided between all my
children - and their children for them to share and share alike as they would
do under our law of Distribution were I to die intestate.
And lastly I do hereby constitute and appoint my trusty faithful and dutiful
son Benjamin F. Sutton my lawful executor to all interest
and purposes to execute this my last will and testament according to the intent

Also a Frederick buried in this cemetery.
